Orange Township will not be responsible for over loads, all stone must be delivered in legal loads as described by the Ohio State Department of Transportation. Each and every load delivered to Orange Township garage upon delivery. The material that will be paid for will be the material that would produce an Ohio gross legal load, to clarify, no amount of material that creates a load over the Ohio Gross Legal Load limit will be paid for by Orange Township. The successful bidder is required to have a truck, trailer and driver capable of delivering and tailgating material directly on Township roads under the supervision of a representative of Orange Township. This will take place only under regular township working hours and at the same price per ton as stock piled stone, whenever the Township requests this service. The successful bidder must guarantee that amounts of stone of and size and cinders or grits for ice control needed by the township at anytime can be delivered within 24 hours notice by the township. Should the successful bidder fail to deliver the materials within 24 hours of being requested to do so, said bidder shall reimburse Orange Township for the difference between the contract price per ton and the cost incurred by the township in obtaining said materials from another supplier. The successful bidder will specify what quarry the stone is being obtained from. The successful bidder will be responsible for any contamination in stone. The successful bidder must specify the source for each grade of stone. Bidder must guarantee the bid for one year from the date the contract is awarded by the Township. The successful bidder must provide a certificate of appropriate insurance, (liability insurance minimum 4 million dollars) with Orange Township named as the Certificate Holder, current Worker's Compensation Certification and certification that all Real Estate and Personal Property taxes have been paid. If the successful bidder hires or contract with any other person or trucking company that is not insured by the prime bidder, the Township must be provided with their names, addresses, certification of insurance, certification of Worker's Compensation coverage, and certification that all Real Estate and Personal Property taxes have been paid by them. Orange Township reserves the right to reject any and all bids on any basis, without disclosure of a reason. The failure to make such a disclosure shall not result in accrual of any right, claim or cause of action by an unsuccessful bidder against Orange Township or the Orange Township Trustees. The Trustees of Orange Township reserve the right to cancel this contract on 30 days notice to the successful bidder for any reason. All Bids must be sealed and in an envelope marked "LIMESTONE, GRITS AND CINDER BID".
