Site work and paving for a road / highway in Marlborough, Massachusetts. Completed plans call for site work for a road / highway; and for paving for a road / highway.
Questions concerning the bid specifications must be submitting in writing via email to Attn: Mark Dascoli at mdascoli@marlborough-ma.gov no later than 3 business days prior to the scheduled bid opening. All questions and answers shall be distributed as an addendum to all on record as having received the bid documents. Bids shall be accompanied by a bid deposit of not less than five (5%) percent ofthe value ofthe bid in accordance with M.G.L. c. 30, 39 M (a), and made payable to the City of Marlborough, the Awarding Authority. The bid deposit may be submitted in the form of a certified check, a treasurer's or cashier's check issued by a responsible bank or trust company or a Bid Bond. In lieu of a Bid Bond, deposit checks must be submitted in a sealed envelope with a completed Bid Bond Affidavit form and received by the City before the bidding deadline. Due to COVID-19 bidding protocols, at this time, the City is not accepting cash bid deposits. In accordance with the provisions of applicable statutes, laws, rules, regulations, and ordinances, the City of Marlborough does not discriminate in employment or the provision of services and all qualified contractors will receive consideration without regard to race, age, color, religious creed, gender, handicap, sexual orientation, veteran's status or national origin. The City reserves the right to cancel this procurement process, or reject in whole or in part any and all bids, ifthe City determines that cancellation or rejection serves the best interests ofthe public to do so. The project is paid for by a grant to the City from the Massachusetts Department of Housing and Community Development CDBG program. The Contract must comply with the Davis-Bacon Act (40 U.S.C. 276a - a7), the Contract Work Hours and Safety Standard Act (40 U.S.C. 327 - 330) as it relates to the Federal wage rates, Workmen's Compensation and condition of employment as amended and other regulations which are included in the bid and contract documents, or any other state or federal construction law or regulation. The Contract must comply with the most current Schedule of Minimum Wage Rates established by the Massachusetts Department of Labor and Industries for the contract work. The higher ofthe federal and state wage rates per category shall apply. Equal opportunity and affirmative action in employment shall apply. Minority Business Enterprise (MBE) and Women's Business Enterprise (WBE) policies of the Commonwealth of Massachusetts and the City of Marlborough are applicable to this Contract. The "Fair Share" construction goal for this project is a minimum of 4.2 percent MBE participation and 8.8 percent WBE participation by state-certified MBEs and WBEs. The Contractor shall, pursuant to this Agreement, perform all Work required by the Contract Documents for the Reconstruction of Harrison Place and Appurtenant Work, Contract ED 2022-02 (hereinafter called the "Project") in the City of Marlborough, Massachusetts, and to accomplish any and all work incidental thereto in accordance with the plans and specifications prepared by the Department of Public Works Engineering Division dated March 23, 2022 and addenda numbers ____ to attached hereto as prepared by the City.
