The scope of work includes all work associated with the removal of dead and damaged trees in city street rights-of-way, including cutting, hauling tree debris for disposal, traffic control, and disposal fees. Trees shall be cut so that stumps are left no higher than six (6) inches above grade. Any areas or structures damaged during the tree removal shall be repaired to original conditions by the contractor. Trees to be removed will be marked with orange button caps and red ribbon. There is a bid form with location included in bid package. A site visit is required before submitting bids. The contractor shall acquire insurance prior to the commencement of work, and maintain the policy throughout the contract. Insurance limits are set as follows: Workers Compensation providing Statutory Limits and Employers Liability Limits of not less than $500,000.00; General Liability and Vehicle/Equipment Liability with limits not less than $1,000,000.00 per occurrence covering bodily injury and property damage, and not less than $1,000,000.00 in Excess or Umbrella Liability. Policy shall include the City of Kinston as additional insured party. 5) The Contractor hereby agrees to indemnify and hold the City harmless from and against any and all loss, cost, damage, suit, liability, claim, settlement cost, or expense, for loss of, or damage to, property, including Contractor's or City's employees, incidental to the work performed under this contract. The Contractor shall, at the City's option, defend the City at the Contractor's sole expense in any litigation involving the same, regardless of whether such work is performed by Contractor, its employees, or by its subcontractors, their employees, or any or all of them, provided that such indemnification and hold harmless shall not apply to claims for loss, damage, injury, or death caused solely by negligence of the City. Bidders are to submit all supporting documents including W-9 tax forms, Minority Business Affidavit A with Identification of Minority Business Participation form or Affidavit B, and other information required in the bid request.
