This Contract is not subject to prequalification. The Project includes demolition of existing fencing and gates; installation of fencing at Montair ES, Country Club ES, Pine Valley MS, Stone Valley MS and California HS including ornamental fencing, chain link fencing, pedestrian gates and vehicular gates. Each bid must conform and be responsive to this notice and all other documents comprising the contract documents. All forms must be completed, signed, and returned with the bid. No bidder may withdraw its bid for a period of sixty (60) calendar days after the date set for the receipt of bids. The successful bidder shall file a Payment Bond issued by an admitted Surety authorized to conduct business in the State of California approved by the District. A Performance Bond will also be required. Owner, or its designee, has determined that certain materials, services, products or things designated by specific brand or trade name shall not be subject to Public Contract Code section 3400(a) in order that a field test or experiment may be made to determine the product's suitability for future use; in order to match other materials, services, products or things in use on a particular Owner public improvement either completed or in the course of completion; in order to obtain a necessary item that is only available from one source; and in order to respond to an emergency declared by Owner. Each Bidder submitting a bid must be a Department of Industrial Relations registered contractor pursuant to Labor Code section 1725.5 ("DIR Registered Contractor"), unless an exception expressly provided in the Labor Code applies. This project is subject to compliance monitoring and enforcement by the DIR. If awarded the Contract, at all times during performance of the work, the Bidder and all Subcontractors of any tier shall be DIR Registered Contractors and continue to comply with all DIR requirements. No bid will be accepted from a contractor who has not been licensed in accordance with the California Business and Professions Code at the time the bid is submitted. Each bidder shall have a Class "A, B or C13" license and shall maintain that license in good standing through the contract completion and all applicable warranty periods. The District reserves the right to reject any or all bids, to accept or reject any one or more items of a bid, or to waive any irregularities or informalities in the bid or in the bidding process.
