Prospective Bidders must be prequalified in accordance with 720 CMR 5.00, "Prequalification of Contractors". Bids received by Contractors not on the official or waiver contractor lists issued by MassDOT Prequalification Office will be considered not qualified and their bid will not be opened. This contract shall be made available for purchases of said materials to other Town of Wellesley Departments and Boards. Each bid shall be accompanied by a bid deposit in the form of a bid bond, certified check, or a treasurer's or cashier's check issued by a responsible bank or trust company, payable to the Town of Wellesley. Bid deposit shall be $500. This contract, in accordance with the Chapter 303 Acts of 2008, contains a price adjustment for both liquid asphalt emulsions and Diesel Fuel and Gasoline. The base price for asphalt cement, Diesel Fuel and Gasoline on this project will be the MassDOT Period Prices. These shall be specified in the bid package. No such envelope shall contain more than one bid. The Department of Public Works reserves the right to accept any bid item or combination of bid items or reject any or all proposals, as in its sole judgment, the best interest of the Town of Wellesley would be served by so doing. All bids must be firm and continue in effect for a period of sixty (60) days from date of bid opening. Any such bid that is accepted by the Town must continue in full effect until December 31, 2022 at which time the contract will expire. The contract will be awarded to the lowest responsible and eligible bidder whose bid, conforming to the Invitation for Bid and Specifications will be in the best interest of the Town, price and other factors considered. The Town reserves the right to reject any or all bids and to waive informalities and minor irregularities in bids received. As part of this contract, attached hereto, is a noncollusive Bidding Certificate that must be signed. Failure to do so by duly authorized parties will automatically disqualify said bid making its submission null and void. One contract will be awarded to the responsive and responsible bidder offering the lowest total price for the contract based on the unit costs and the estimated quantities. It is the purpose of the Town not to award this contract to any bidder who does not furnish evidence satisfactory to the Town that Contractor has the ability and experience in this class of work and that they have sufficient capital and plant to enable them to prosecute the same successfully and to complete it within the specified time and that they will complete it in accordance with the terms thereof.
