All questions shall be submitted in writing via the bidding platform prior to Monday, April 11, 2022 noon EST. The specific section and page number to which each question refers to is to be indicated. Each proposal shall be accompanied by an unconditional Bid bond, cashier's check or by a Certified Check, made payable to the District, equal to ten percent (10%) of the amount of the proposal, but not in excess of $20,000. The successful bidder shall within ten (10) calendar days after notice of award submit a Performance Bond in an amount equal to one hundred percent (100%) of the total contract price to include the bid price plus any alternates awarded by the District as security for the faithful performance of this contract and also a Payment Bond in an amount equal to one hundred percent (100%) of the contract price to include the bid price plus any alternates awarded by the District as security for the payment of all persons and firms performing labor and furnishing materials in connection with this contract. The Director reserves the right to waive, in his sole discretion, any bid requirements when such waiver is in the best interests of the District, and where such waiver is permitted by law. The Director reserves the right to reject any and all bids when such rejection is in the best interests of the District. The Director, also may reject the bid of any Bidder who, in his judgment, is not responsible, or capable of performing the Contract based on financial capability, past performance or experience; or other material factors. A bidder whose bid is so rejected may request a hearing before the District by filing a written request to the Director. The Director reserves the right to renegotiate or contract separately for any rejected unit price. The Contractor shall begin performance immediately after receiving a Notice to Proceed and complete within 180 working days
