The deadline for questions is WEDNESDAY, APRIL 27 th , 2022 @ 12:00 P.M., NOON. Bid Security: A Bid Bond, Certified Check, or Cashiers Check made payable to the County of Cape May, in the amount of ten percent (10%) of the total bid (not to exceed $20,000.00) MUST accompany this RFP. Failure to comply shall constitute a material defect that can neither be cured, nor waived, and shall result in rejection of the RFP. This security shall be subject to forfeiture and retention by the County, in lieu of other remedies, should the successful Bidder fail to execute the Contract within twenty-one (21) days after award of the Contract, pursuant to N.J.S.A.40A:11-24(b). Certificate of Surety: Bidder shall submit with the bid a Certificate (Consent of Surety) with Power of Attorney for the full amount of bid price from a Surety Company authorized to do business in the State of New Jersey stating that it will provide said bidder with a Performance Bond in the full amount of the bid. This certificate shall be obtained in order to confirm that the bidder to whom the contract is awarded will furnish Performance and Payment Bonds from an acceptable surety company on behalf of said bidder, any or all subcontractors or by each respective subcontractor or by any combination thereof which results in performance security equal to the total amount of the contract, pursuant to N.J.S.A. 40A:11-22. A Certificate of Surety: from an insurance company authorized to issue Surety and Performance Bonds in the State of New Jersey. The Certificate of Surety shall state that upon award of a contract by the County, that a Performance Bond shall be issued and supplied to the County in an amount equal to one- hundred (100%) percent of the total contract and/or an amount established by the County. The Bond shall be for the faithful performance of the contract and in place for the total duration of the contract.
