This section is to be completed by the Offeror and this page must be returned with the bid. In compliance with this Invitation For Bid and subject to all terms and conditions imposed herein, which are hereby incorporated herein by reference, the undersigned offers and agrees to furnish the services and/or items requested in this solicitation if the undersigned is selected as the successful Bidder. No Bid may be withdrawn within a period of sixty (60) days after Bid opening except for clerical errors, as set forth in part (1) of Section 2.2-4330(B), Virginia Code, 1950, as amended. Notices of bid withdrawal must be submitted in writing to the Purchasing Division. All questions must be submitted before 5:00 p.m., April 21, 2022. If necessary, an addendum will be issued and posted to the County website on the Current Bids/RFP Requests tab electronically., (1) A bid, payment or performance bond for contracts for goods or services other than construction may be required if provided in the Invitation for Bid. (2) The amount of the bid bond shall not exceed five percent (5%) of the total amount of the bid. (3) In lieu of a bid bond, a bidder may furnish a certified check or cash escrow in th face amount required for the bond. (4) Upon award of any public construction contract exceeding $100,000 awarded to any prime contractor, such contractor shall furnish: i. Performance bond in the sum of the contract amount. ii. Payment bond in the sum of the contract amount. If the gym is not turned over to Roanoke County Public Schools AND operational on Friday July 29, 2022 at 8:00 AM, a Liquidated Damages Fee of $250 per day will be deducted from the final payment to the Contractor. Liquidated damages will not be enforced if delays are due to conditions presented by RCPS or if RCPS Operations staff approve in writing an extension to the due date written in the bid document. The County may make investigations to determine the ability of the Bidder to perform the work and/or provide the services and/or items as described in this IFB. The County of Roanoke reserves the right to reject any Bid if the Bidder fails to satisfy the County of Roanoke that it is qualified to carry out the obligations and requirements requested in this IFB.
