Bid bond or certified check for 10% of the total base bid payable to "West Earl Township" (Owner) shall accompany each proposal, to be forfeited in liquidated damages should the bidder default in execution of the contract within 180 days after award of same. Bids may not be withdrawn within 60 days after bid opening. The Owner shall award the contract to the lowest responsible and responsive bidder or reject all bids within sixty (60) days from the date of the bid opening; provided, however, if the award is delayed by the required approval of another governmental agency, the sale of bonds, easement acquisition or the award of a grant, the Owner shall reject all bids or award the contract to the lowest responsible and responsive bidder within one-hundred twenty (120) days from the date of the bid opening.
