The right is reserved by the city of porterville to reject any or all bids, to evaluate the bids submitted and to award the contract according to the proposal which best serves the interests of said city. The contractor shall have seventy (70) working days from the effective date of the notice to proceed to complete the required work. The contractor shall pay the city liquidated damages in the amount of three thousand dollars ($3,000.00) a day for each calendar day the project is delayed beyond the "Time of completion date." The city will withhold five percent (5%) retention from payments due the contractor until thirty-five (35) days after date of recordation of the notice of completion. The contractor may elect to receive one hundred percent (100%) of payments due under the contract by depositing securities of equivalent value with the city in accordance with the provisions of the california public contract code section 22300. Such securities, if deposited by the contractor, shall be valued by the city, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in section 22300 and section 16430 of the california government code. A log of borings is contained in the appendix for use by the contractor. It is intended to aid the contractor in establishing the type of soils to be encountered but may or may not be indicative of all soil types to be found throughout the project limits.
