The PUBLIC BODY retains the tender guarantee of the lowest BIDDER compliant until the final award of the Contract. It also retains the bid guarantee of the second and third lowest compliant BIDDERS until the final award of the Contract to a CONTRACTOR. 4.01.03 Delivery The tender guarantee is delivered to the successful bidder in exchange for the performance guarantee required in section 4.02. 4.02 Guarantee of performance and obligations The successful TENDERER must provide, after the awarding of the Contract, a guarantee of performance as well as a guarantee of the obligations of the CONTRACTOR for pledges, materials and services in accordance with the terms and conditions provided for in part 4.00 of the Contract.
