RELATIONSHIP BETWEEN SECTIONS L AND M. Your attention is directed to the functional relationship between Sections L and M of this solicitation. MAGNITUDE OF CONSTRUCTION The disclosure of magnitude for this project is between $1,200,000 and $1,800,000. LIMITATIONS ON SUBCONTRACTING (FAR 52.219-14) A. The prime contractor will not pay more than 85% of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 85% percent subcontract amount that cannot be exceeded. The prime Contractor shall submit a monthly written report to the CO demonstrating that it has performed the required percentage of costs. Provide and illustrate the calculation for work to be performed by the prime and similarly situated entities as opposed to the subcontractors that are not similarly situated. Page 58 of 66 B. Definition - "Similarly situated entity" means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award and that is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform.
