No definite date for rebid Engineer's Estimated Cost: $5,500,003 to $5,500,003 Pre-Qualification for Bidders: Not Required License Type Required: Class A or C-12 Earthwork & Paving Project Duration: 60 Work Days Liquidated Damages: $3,000.00 Per Work Day The work consists, in general, of grading to remove existing landslide areas, replace with cement and/or lime treated backfill and engineered fill, install geogrid mat reinforcement, install subdrains, cleanouts and performing other items or details, not mentioned above, that are required by the Plans, Standard Specifications or these Special Provisions. The work is to be performed to project substantial completion within sixty (60) working days and to project final completion (only punch list items remaining) within twenty (20) working days after project substantial completion, which collectively, referred to as the Contract Time. The Contractor shall pay to the City of Hayward the sum of $3,000 per day in excess of the number of working days prescribed above, for each and every calendar day delay in finishing the work. See details in the Special Provisions. At the time this contract is awarded, the Contractor shall possess either a Class A license or a combination of any of the following license classifications which constitute a majority of the work: of C12 Earthwork & Paving. When the Engineer's estimated cost of construction is greater than $1,000,000, the contract is subject to the Community Workforce Agreement approved by the Hayward City Council on April 14, 2015. The successful bidder and all subcontractors, at any tier, will be required to sign an Agreement to be Bound which can be found in Exhibit I in the Special Provisions as a condition precedent to entering into any contract for this project. This project site could potentially contains naturally occurring asbestos and as such is required to adhere to the requirements of the Bay Area Air Quality Management District and California Code of Regulations Title 17, Section 93150 Asbestos Airborne Toxic Control Measure for Construction, Grading, Quarrying and Surface Mining Operations. The contractor and all subcontractors shall implement and adhere to the requirements as set forth in the attached Exhibit L, Asbestos Dust Mitigation Plan. Pursuant to Section 1770 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of per diem wages applicable to the work to be performed, which rates are filed in the office of the Engineer, and copies of which are available to any interested parties on request. In accordance with Labor Code Section 1771.1, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work unless currently registered with the State Department of Industrial Relations and qualified to perform public work pursuant to Labor Code Section 1725.5. Section 1771.1 applies to any bid proposal submitted on or after March 1, 2015 and/or any contract for public work entered into on or after April 1, 2015. Job Site Notices. Contractor shall post an Economic Development Agency job site sign as detailed in the project plans and these Special Provisions. A bid submitted by any Contractor who is not licensed to engage in business or act in the capacity of a Contractor shall be considered non-responsive and shall be rejected, except for those exceptions governed by Section 7028.15 of the Business and Professions Code. The City of Hayward hereby notifies all bidders that bidders will not be discriminated against on the grounds of race, color, religion, national origin, ancestry, place of birth, sex, sexual orientation, age, or disability in consideration for an award. Attending this conference is not a condition of submitting a bid, but prospective bidders are encouraged to attend. Any questions regarding the project requirements shall be submitted in writing as detailed below. Bidders shall visit the site and review the site conditions prior to bid. Failure for Bidder to conduct a site visit will not be considered in change orders or claims. Bidders are required to submit questions in writing, via email, to Alex. Tat@hayward-ca.gov, no later than Friday, May 13th, 2022 by 4:00 pm, no exceptions. No other questions will be received after the deadline. Only written inquiries will be permitted. Copies of questions and answers will then be posted on the Construction portal in a written document to all parties who are registered plan holders on Construction Bidboard. Each bid must be accompanied by certified or cashier's check, or bidder's bond duly executed by a responsible corporate surety authorized to issue such bonds in the State of California, made payable to the City of Hayward for an amount equal to at least ten (10) percent of the amount bid. The successful bidder shall furnish a Labor and Materials Bond and a Faithful Performance Bond. Bidder's attention is directed to Section 6-1, "City of Hayward Nondiscriminatory Employment Practices Provision," of the Special Provisions. Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available at the office of the City Engineer and available from the California Department of Industrial Relations' Internet web site at portal The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are available at the portaland are included in these special provisions. Addenda to modify the Federal minimum wage rates, if necessary, will be issued to all plan holders. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. If there is a difference between the minimum wage rates predetermined by the United States Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The City will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise availabie for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. The Contractor may elect to receive 100 percent of payments due under the contract from time to time, without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Sections 22300 of the Public Contract Code. All expenses of such substitute deposit shall be borne by the Contractor. Securities eligible for investment under the section shall include those listed in Section 16430 of the California Government Code or certificates of deposit of a bank or savings and loan association. The Contractor shall be the beneficial owner of any securities substituted for monies withheld and shall receive any interest thereon. Such securities, if deposited by the Contractor, shall be valued by the City's Finance Director (Treasurer), whose decision on valuation of the securities shall be final. Alternatively, upon the Contractor's request, the City will make payment of retentions earned directly to the escrow agent. The Contractor may direct the investment of the payments into securities, and the Contractor shail receive the interest earned on the investments upon the same terms provided for securities deposited by the Contractor. Upon satisfactory completion of the contract, the Contractor shall receive from the escrow agent all securities, interest and payments received by the escrow agent from the City, pursuant to the terms in Section 22300 of the Public Contract Code. Bidders may download copies of bid documents, related attachments and all future communication and correspondence regarding this bid process from Construction portal. The City of Hayward will be a distribution point for the bid documents. The bid documents may also be reviewed at the various builders exchange and construction service offices throughout the San Francisco Bay Area.
