The payment and performance assurances must be for an amount at least equal to the contract price and must be in the form of a bond, an irrevocable letter of credit, or an escrow account acceptable to the City. In case the bidder fails to file such contract, performance bond, and payment bond, the amount of the check or bid bond shall be forfeited to the City as liquidated damages (Section 62.15(3) of Wisconsin Statutes).
