Prevailing Wage: Firm shall defend, indemnify and hold NCTD, its elected officials, officers, employees and agents free and harmless from any claims, liabilities, costs, penalties or interest arising out of any failure or alleged failure to comply with Prevailing Wage Laws, if applicable. Firm and subcontractor shall be liable to the United States (in the On-Call Civil Engineering RFSQ - 31221 Page 50 of 132 REV12/14/2021 case of work done under contract for the District of Columbia or a territory, to such District or to such territory), for liquidated damages. Such liquidated damages shall be computed with respect to each individual laborer or mechanic, including watchmen and guards, employed in violation of the clause set forth in paragraph (b)(1) of this section, in the sum of $10 for each calendar day on which such individual was required or permitted to work in excess of the standard workweek of forty hours without payment of the overtime wages required by the clause set forth in paragraph (b)(1) of this section. NCTD reserves the right to reject any and all SOQs and to waive any informalities or irregularities in the SOQ. If all SOQs received are rejected, NCTD reserves the right to re-solicit the services by issuing a new RFSQ or to cancel the solicitation at any time prior to agreement award and not award an agreement.
