A change, modification, or clarification to the Contract Documents can be affected only by a written Addendum issued by SEPTA to ePS. No bid will be opened and considered that is submitted later than the time specified. SEPTA retains the right to reject any and all bids, as determined to be in the best interest of SEPTA. Each bid submitted shall remain firm for at least ninety (90) days from the date of the Bid Opening and may not be withdrawn in whole or in part during that time. Bidder shall forfeit its Bid Security to the extent of the damage to SEPTA occasioned by such withdrawal and if the Bid Security is inadequate to fully recompense SEPTA for the damages occasioned by such withdrawal, bidder shall indemnify SEPTA and pay over to SEPTA the difference between the bid security and SEPTA's total damages, so as to make SEPTA whole. SEPTA, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4, and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-Assisted Programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in regard to any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation, and will not be discriminated against on the grounds of race, sex, color, or national origin in consideration for an award. Contractor will be required to comply with all applicable Equal Employment Opportunity laws and regulations. All bidders will be required to certify compliance with Executive Order 12549 (ineligible contractors). Any contract issued asresult of thissolicitation issubject to a financial assistance contract between SEPTA and U.S. Department of Transportation. Scope of Work: The work includes the elimination of 105 jointed location sand installation of plug rails to be welded in during adjustment procedures (additional 10-20welds). Thermal adjustment to be performed as required in CWR territory for minimum200' either direction of a "closure" type weld. Contractor will only be paid for complete welds that pass the magnetic particle inspection test or ultrasonic testing. Welding will be performed on previously installed 115RE rail and 115RE sections to be installed as plugs where needed.All welding must utilize the electric flash butt welding method. SEPTA estimates this work will be completed in two (2) to three (3) weeks, working weekdays and weekends between the hours of 7am and 3pm approximately. If inclement weather does not permit welding during the scheduled work week, all unfinished work will shift to the following week at no additional cost to SEPTA
