Design/Build Project for Fiber Optic Network Installation Between Milepost G-0.00 and Milepost G-0.55 and Milepost 75.00 and Milepost 247.40 in Westmoreland, Somerset, Bedford, Fulton, Huntingdon, Franklin, Cumberland, York, And Dauphin Counties In addition to the Construction Engineering Liquidated Damages provided for in this contract, if the Contractor fails to complete the project in accordance with all contract requirements by the January 1, 2026, Contractor shall be liable to the Commission for consequential damages in the amount of $3,100/calendar day for each day that any work remains uncompleted, or the network is not fully functioning. The consequential damages represent the costs per day associated with the fiberoptic western network including, but not limited to, labor costs, equipment costs, office rental/lease costs, professional fees, operating costs, life cycle, maintenance or replacement costs, capital improvement costs, insurance related costs and any related carrying costs arising out of or related thereto. The daily sums due will be deducted from any monies allegedly due or to become due to Contractor or its surety. Contractor agrees that these assessments are consequential damages and shall not be construed in any manner as a penalty or liquidated damages. The Provisions of the Pennsylvania Prevailing Wage Act of August 15, 1961, P.L. 987 as amended, together with the rates and regulations promulgated by the Secretary of Labor and Industry, are a part of these contract documents. Upon completion of the construction activities, the Contractor must provide copies of notification of termination and proof of agency approvals to close the permits. If a notification of termination to any environmental agency requires the Commission signature the complete form(s) and any supporting documentation should be provided to the Commission for the appropriate signature.
