Site work for a water / sewer project in San Bernardino, California. Completed plans call for site work for a water / sewer project.

The work under this Contract is the SARER 1A LINING REHABILITATION PROJECT. Contractor shall furnish all labor, equipment and materials to install a geosynthetic clay liner within portions of an existing sedimentation basin and associated basin inlet channel. Each proposal must be accompanied by either a certified or cashier's check or by a corporate surety bond payable to the District on the forms provided, as a guarantee that the bidder will, if an award is made to him/her in accordance with the terms of his/her proposal, promptly execute a contract in the required form, and furnish the necessary insurance certificates, Performance Bond and Payment Bond, in accordance with the Contract Documents. Said check or bidder's bond shall be in an amount not less than 10 percent (10%) of the estimated total contract payments for the maximum amount of work which may be awarded the bidder in accordance with the terms of his/her proposal. The Contractor shall maintain during the life of the contract a protective liability policy and other insurance as provided in the Contract Documents. Insurance industry standard "Accord" forms may be substituted whenever applicable. Strict compliance with all DIR registration requirements in accordance with Labor Code Sections 1725.5 and 1771.1 is a material obligation of the Contractor and all of its subcontractors (of any tier) under the Contract Documents. The foregoing includes, without limitation, compliance with DIR registration requirements at all times during performance of the Work by the Contractor and all of its subcontractors of any tier. Contractor shall provide certification of registration and registration number to the District before a subcontractor shall be allowed to work on the Project. The failure of the Contractor and all subcontractors of any tier to be properly registered with DIR at all times during performance of the Work is a material breach of the Contract and subject to termination for cause. An affirmative and ongoing obligation of the Contractor under the Contract Documents is the verification that all subcontractors of any tier are at all times during performance of the Work are in full and strict compliance with the DIR registration requirements. The Contractor shall not permit or allow any subcontractor of any tier to perform any Work without the Contractor's verification that all subcontractors are in full and strict compliance with the DIR registration requirements. Any subcontractors of any tier not properly registered with DIR shall be substituted in accordance with Labor Code section 1771.1. Contractor or its subcontractors of any tier shall not be entitled to any additional costs or time arising from or in any way related to compliance with the DIR registration requirements. In accordance with the provisions of Sections 1770, 1773 and 1773.1 of the California Labor Code, the Director of Industrial Relations has determined that the general prevailing rates of wages, including employer payments for health and welfare, pension, vacation, travel time and subsistence pay as provided in Section 1773.8 of the California Labor Code, apprenticeships and other training programs authorized by Section 3093 of the California Labor Code, for the crafts, classifications, or types of workers required for any work, in the locality of the project are available from the California Director of Industrial Relations. The successful bidder will be required to pay not less than the rates set forth by the Director of Industrial Relations. In accordance with California Public Contract Code Section 22300, the Contractor will be permitted to substitute securities for any monies that would otherwise be withheld to insure performance of the contract. Any bidder is required to hold a Class A Contractors License at the time the contract is awarded. Any bidder or Contractor not so licensed shall be subject to all legal penalties imposed by law, including but not limited to, any appropriate disciplinary action by the Contractors State License Board. Failure of the bidder to obtain proper and adequate licensing prior to an award of a contract shall constitute a failure to execute the contract and shall result in the forfeiture of the Bid Bond or check. All questions regarding the project must be submitted on the Bidder's Question Form provided and transmitted by email to BidQ@sbvmwd.com no later than 5:00 p.m. on June 23, 2022.
