Pursuant to 41-16-20 of the Code of Alabama, the Alabama Space Science Exhibit Commission DBA U.S. Space & Rocket Center seeks sealed bids for goods and services from qualified vendor for a mobile/modular building. Background: The U.S. Space & Rocket Center is a public science and technology exhibition with an emphasis on space exploration and propulsion systems. Since 1970, the USSRC has had over 17 million guests from across the world to visit and participate in SPACE CAMP programs. The USSRC is a learning center aimed at all segments of the public regardless of age or education in providing an entertaining and inspiring environment and effectively communicating the excitement of space exploration and new technologies. The USSRC is the official visitor center for NASA Marshall Space Flight Center, the Tennessee Valley Authority (TVA) and a representative of Team Redstone, the government entities based on the US Army's Redstone Arsenal. The USSRC is a Commission of the State of Alabama and is a self-sustaining economic enterprise responsible for its own financial viability. Purpose: The purpose for this RFP is to have interested and qualified professional vendors submit sealed bids for the procurement, delivery, and setup of a mobile/modular building to be used for an employee breakroom. Requirements: These requirements are in addition to all specifications and drawings identified herein. * Construction must conform to all Alabama Building Code requirements. * All color selections shall be made at the time of purchase from the manufacturer's standard colors. * Contractor shall be responsible for delivery to site, set up, tie downs, and vinyl skirting shown in specifications to achieve a "turn-key" project. Specifications: Mobile and Modular Building * 14 X 45 Modular classroom building * Codes: 2009 IBC, NEC, ADA, VA, 5B Construction, Use Group E * Wind speed: 130 MPH * Wind exposure: C * Estimated unit height 13' 6" * Type: Outrigger with formed steel @ 48" O.C. * Beam: 12" I Beam spacing 95'-5", ASTM A-36 Steel * Hitch: Detachable * Floor Covering: 12" VCT Preferred * Exterior Walls: R19 minimum insulation, Aluminum siding * Interior Walls: R-11 minimum insulation, Drywall finish preferred * Ceiling: 8' with pre-finished gypsum * Electrical: Pre-wired with outlets on all walls, all appropriate Emergency and exit lighting * HVAC: Pre-mounted wall mount HVAC system * Hardwired smoke detector * Appropriate wind tie downs * Vinyl skirting Follow Up Questions: All follow up questions must be submitted in writing to Sam Mitchell, Director of Procurement at samm@spacecamp.com Vendors Shall Submit with their Quote package the following: 1. State of Alabama Disclosure Statement attached. Completed and notarized. 2. Immigration Form and if applicable, the documentation showing you are enrolled in E-verify, attached. As a condition to the award, the contracting business entity or employer shall not knowingly employ, hire for employment, or continue to employ an unauthorized alien within the State of Alabama. If you do employ anyone in the State of Alabama, the business entity is required to furnish documentation that you are enrolled in E-verify. Failure to submit this documentation could result in disqualification. 3. Awarded Contractor must be able to provide a Certificate of Insurance per the Terms and Conditions below. Please note USSRC requires Contractor's to carry Workman's Compensation Insurance regardless of whether or not number of employees is under State requirement. 4. Vendor must also provide a copy of their W-9 form as part of the bid response. 5. The USSRC is tax exempt. A tax-exempt certificate will be provided to the successful vendor. Insurance Requirements: 1. Worker's Compensation: Statutory Limits 2. Automobile: $1,000,000 combined single limit liability $1,000,000 hired car/non owned liability 3. General Liability: $1,000,000 general aggregate $1,000,000 products/completed operations $1,000,000 personal injury $1,000,000 each occurrence $50,000 fire legal liability $5,000 medical payments Please provide a Certificate of Insurance with U.S Space & Rocket Center, the Alabama Space Science Exhibit Commission, and all Commission members, Officers, and Employees as additional insured, certificate must specify a 30-day notice for cancellation. Submitted Bid Pricing: The bid Price shall be all be all inclusive and include all travel, labor, tools, permits, rental equipment, man lifts and any other associated costs to perform work outlined in this bid. Total price to include all work outlined in bid. Intention: The intention is to award to one (1) vendor for all services, or whatever is in the best interest of the USSRC. Stipulations: The U.S. Space and Rocket Center reserves the right to cancel invitations for bids or request for proposals without penalty when it's in their best interest. Notice of cancellation shall be sent to all individuals or entities solicited. Any bid not conforming with the specifications or requirements set forth by the USSRC as listed in the bid request may be rejected. Bids may also be rejected if they are made by a bidder that is deemed un-responsible or un-responsive due to a lack of qualifications, capacity, skill, character, experience, reliability, financial stability or quality or services, supplies, materials, equipment, or labor. Terms and Conditions: 1. AWARD: The U.S. Space and Rocket Center reserves the right to accept or reject any or all bids, or any portion thereof. Bids may be awarded either by line item, in product groups, or all-or-none, whichever is in the best interest of the U.S. Space and Rocket Center. 2. DISCLOSURE: A State of Alabama Disclosure Statement (required by Act 2001-955) is enclosed with this bid. The successful bidder will be required to complete. Failure to do so will disqualify the bidder. 3. PRICES AND PAYMENT TERMS: Terms are Net 30 unless otherwise stated. Bids containing "payment in advance" or "COD" may be rejected. Any contract, additional written agreement, or any other document required by your Company to be signed must be submitted with your bid. No errors will be corrected after bids are opened. No prices shall include any State or Federal taxes. USSRC is tax exempt and tax-exempt certificate can be furnished upon request. No oral, electronic, or telephone bids, proposals, or modifications will be accepted. All costs associated with the preparation of proposals in response to this Bid/RFP shall be borne by the responding individual(s) or company. 4. NON-COLLUSION: Signing of bids and/or proposals by the contractor and submitting to USSRC shall affirm that the contractor has not been in any agreement or collusion among bidders or prospective bidders in restraint of freedom of competition by agreement to bid at a fixed price, or to refrain from bidding, or otherwise. 5. NEW PRODUCTS: Unless specified, all products for purchase must be new, never previously used, and the current model and/or packaging. The manufacturer's standard warranty will apply unless otherwise specified in the bid. 6. QUALITY: Brand names, catalog numbers, etc. are used to indicate levels of quality. If you are unable to furnish an item as specified and desire to offer a substitute, enclose sufficient literature for an evaluation. Any attachment becomes a part of your bid/proposal inquiry and must be signed by the bidder 7. SAFETY: The contractor shall take all necessary precautions for the safety of the employees on the work and shall comply with all applicable provisions of Federal, State, and Municipal Safety Laws and Building Codes to prevent accidents or injury to persons on, or about, or adjacent to the premises where the work is being performed. In addition, contractor shall provide safety plans/program appropriate for the scope of work for review by USSRC Safety Officer. 8. BONDS: When required it will be indicated on the Bid or RFP form. A Bid Bond payable to the U.S. Space and Rocket Center, in an amount not less than five (10%) percent of the amount of the bid, but in no event more than ten thousand dollars ($10,000) must accompany the Bid or RFP. The Bid Bond shall be in the form of a cashier's check drawn on an Alabama bank or a Bid Bond executed by a surety company duly authorized and qualified to make such bonds in the State of Alabama, payable to the U.S. Space & Rocket Center 9. BID SUBMISSION: All bidders must use the provided USSRC bid form to communicate Bid/RFP pricing unless otherwise specified in writing by USSRC. Original bid form provided must accompany all Bids/RFPs with an original signature. All information shall be entered in ink or type-written in the appropriate spaces. Mistakes shall have a strikethrough, be initialed and dated by signer of bid, and have correction listed directly thereafter. All bids must be signed. Unsigned bids will be rejected. All bidders must use the provided USSRC envelope to return their Bid/RFP, unless it is necessary to use another envelope/container to assure all material included in Bid/Proposal is properly sealed. If another envelope/container is used to return the Bid/RFP, it must have the Bid Number, Opening Date, and Time clearly noted on it. Each numbered bid must be in separate envelope. Original return envelope provided must accompany all bids. 10. DELIVERY: Time of delivery shall be stated as the number of calendar days following receipt of the order by the vendor, to receipt of the goods by the U.S. Space and Rocket Center. Delivery time may be a criterion in awarding bids. Failure to deliver within the time specified could result in cancellation or a penalty when indicated. Failure to deliver within the time specified, in the negotiated contract, could result in cancellation or a penalty of $50,000. 11. DELIVERED PRICING: All prices quoted shall be F.O.B. Delivered to U.S. Space and Rocket Center, One Tranquility Base, Huntsville, AL 35805. If not quoting FOB Delivered price, shipping point and shipping cost must be listed for evaluation purposes. 12. BID TERMS: Unit prices, Extensions, and Total Prices are required. In the event of a discrepancy between the unit price and the extension, the unit price shall govern. 13. BID OPENING: Bidders may attend the Bid/RFP opening, but no information or opinions concerning the bid award will be given at the opening. Bid results and tabulations will be made available by E-mail. 14. WARRANTIES: Should merchandise described on this bid contain a manufacturer's warranty, bidders must state the warranty terms. Bids offered for merchandise when no warranty applies must clearly state: "NO WARRANTY COVERAGE". Failure of bidders to furnish this data may be cause for rejection. 15. INDEMNIFICATION: Contractor shall indemnify and hold harmless USSRC for any liability, damage, injury or claim of any kind or nature arising out of the performance of this Agreement. Such indemnity shall include but not be limited to, all attorney's fees incurred because of any such liability, damage, injury or claim, and any costs of enforcing this indemnity, including attorney's fees. 16. GOVERNANCE/MEDIATION: The laws of the State of Alabama shall govern this agreement. Courts in the State of Alabama, Madison County, shall have venue and jurisdiction for all matters concerning this agreement. Any litigation or mediation must take place in Madison County, AL. 17. CERTIFICATION PURSUANT TO ACT NO. 2006-557: Alabama Law (Section 41-4-116, Code of Alabama 1975) provides that every bid submitted, and contract executed shall contain a certification that the vendor, contractor, and all its affiliates that make sales for delivery into Alabama or Leases for use in Alabama are registered, collecting, and remitting, Alabama State and Local Sales, Use, and/or Lease Tax on all on all taxable sales and leases into Alabama. By submitting this bid, the bidder is hereby certifying that they are in full compliance with Act No. 2006-557, they are not barred from bidding or entering into a contract pursuant to 41-4-116 and acknowledges that the awarding authority may declare the contract void if the certification is false.
