MS-944: The length of the Contracts will be from August 11, 2022 to October 25, 2022. Bidders shall submit the following with the respective bids: a. Proposal and Contract MS-944 (Contract No. 1: pages 1 - 2; Contract No. 2: Pages 1 - 2); b. Special provisions to Contract MS-944 (Attachment #1-A), signed and dated by the Contractor; c. Anti-Collusion Affidavit (D-7126 (7-09)); d. Public Works Employment Verification Form; e. Bid Bond (10%). Contractor warrants that he is in compliance with the Americans with Disabilities Act (Public Law 101-336) and that it will, in carrying out requirements of this Contract; comply in all respects with the provisions of the Act and its implementing regulations. Contractor warrants that he is in compliance with the United States Omnibus Transportation Employee Testing Act of 1991, and related Federal Highway Administration Regulations regarding commercial driver's license (CDL) requirements for its employees; and that he will, in carrying out the requirements of the Contract, comply in all respects with the provisions of this Act. Contract No. 1 has been determined to be in excess of $100,000.00 of designated construction work; therefore, all Contractors and Suppliers are required to comply with the rules and conditions of the Pennsylvania Department of Labor and Industry Prevailing Minimum Wage Determination. Wage Certifications must be submitted to the City, prior to release of any payments. Pennsylvania Prevailing Wage Rates apply to all work, and the Wage determinations are attached herein: PA Prevailing Wage Determination - 22-04793, dated 6/1/2022 A bid bond by acceptable surety or a certified check made payable to the City of York in the amount of 10% of the maximum bid must be provided by each bidder with their bid. The successful bidder, when awarded a contract, shall furnish Performance and Payment Bonds (with suitable surety), as specified in the Contract. All Successful Bidders will be required to furnish the following: a. Certificate of Insurance, in accordance with attached requirements; b. Performance Bond; c. Payment Bond; d. Workmen's Compensation Affidavit; e. Payroll Certifications. All materials and workmanship must be in accordance with C. S. Davidson, Inc., Section 7 - Technical Provisions (Standard), January, 2010 printing and PennDOT Publication 408. The City of York reserves the right to reject any or all proposals and to make an award which is in the best interest of the City. The Owner fully intends to construct the work for which bids are solicited. However, the Owner specifically reserves the right, which all bidders acknowledge by submission of a bid, to reduce quantities and/or eliminate projects to meet available finances. Reduction of quantities or elimination of projects will not constitute grounds of additional or compensatory charges to the successful bidder. A Pre-bid meeting will not be held. Contract No. 1 will be awarded to the lowest responsible bidder, based on the combined low total for Bid Items A through 14E. Contract No. 2 will be awarded to the lowest responsible bidder, based on the combined low total for Bid Items A1 through A4.
