No bid will be received or considered by the Owner unless the bid contains: 1) a statement that bidder will comply with the provisions of ORS 279C.840; 2) a statement as to whether the bidder is a resident bidder as defined in ORS 279A.120. Before starting work, the contractor and every subcontractor employed under this contract is required to have a public works bond filed with the Construction Contractors Board, in accordance with ORS 279C.830 (3), unless the contractor or subcontractor is exempt under ORS 279C.836 (4), (7), (8), or (9). Upon award of this contract, the Owner is required to pay a fee to the BOLI Prevailing Wage Rate Unit in accordance with ORS 279C.830 (2) and OAR 839-025-0200. The amount of the fee shall be one tenth of one percent (.001) of the contract price; however, the fee must be no less than $250 or more than $7,500 regardless of the contract price. The Owner may reject any bid not in compliance with all prescribed public bidding procedures and requirements and may, for good cause, reject any and all bids upon a finding of the Owner that it is in the public interest to do so. No bidder may withdraw or modify a bid after the hour set for the receipt of bids, and thereafter until the lapse of 70 days after the bid opening.
