This is a service / maintenance or supply contract in Hudson, Massachusetts. Contact the soliciting agency for additional information.

Any and all questions / clarifications shall be submitted in writing to info@hudsonlight.com no later than Thursday, June 30th, 2022. The Bid shall cover the purchase of Services and Material, as set forth in the attached specifications. The bid shall consist of a period of one year with an option for a second year. The Town will accept or reject any or all bids on any or all items within thirty days after the date set for opening bids. In order for a Bidder to receive consideration, a minimum of five years of direct experience in Excavation is required. Bidder must be qualified to work around live electrical lines. The Town may make such investigation as it deems necessary to determine the ability of the Bidder to furnish the Supplies, Materials, Equipment, and Services, and the Bidder shall furnish to the Town all such information and data for this purpose as the Town may request. The Town reserves the right to reject any bid if the evidence submitted by or investigation of such Bidder fails to satisfy the Town that such Bidder is properly qualified to carry out the obligations of the contract and to deliver the Supplies, Materials, Equipment and Services contemplated therein. Conditional bids will not be accepted. Bids shall include all transportation charges. Bids containing an escalator clause will not be accepted. A Bid bond duly executed by the Bidder as principal must accompany each bid and having as security thereon a Surety Company approved by the Town in the amount of five (5) percent of the bid. Such bid bonds will be returned to all except the three lowest formal Bidders within ten (10) days after the formal opening of the bids, and the remaining Bid Bonds will be returned to all other Bidders, except the successful Bidder within 48 hours after the Town and the accepted Bidder have executed the contract, or if no contract is executed within thirty (30) days after the date of opening of the bids upon the demand of the Bidder at any time thereafter so long as they have not been notified of acceptance of their Bid. A Bidder, if they so choose, may deposit with the Town a certified Check in the amount of five (5) percent of the Bid as Bid Security, which will be treated as a Bid Bond. The successful Bidder, upon failure or refusal to execute and deliver the contract required within five (5) days after they have received notice of the acceptance of their proposal, shall forfeit to the Town as liquidated damages for such failure or refusal an amount in cash equal to the security deposited with their Bid. The Contractor for this work will be expected to deliver all Supplies, Materials, Equipment, and Services during normal working hours from 7:00 a.m. to 4:00 p.m. in accordance with the delivery dates and places set forth in the scope of work. For periods of extended outages during storm restorations and emergencies, overtime will be required as requested by the Town. Payment will be based on overtime rates in accordance with this agreement.
