Requirement to Mitigate the Spread of COVID-19. The Contractor and all subcontractors for the Work shall comply with all applicable Federal, State, Riverside County, and City of Temecula statutes, regulations, orders, and ordinances. This requirement specifically includes, without limitation, compliance with the "Safety and Health Guidance COVID-19 Infection Prevention in Construction" issued by the California Department of Industrial Relations, Division of Occupational Safety and Health and Safety on July 20, 2020 and as may be amended from time to time by the Department, relating to mitigating the transmission of COVID-19 on the project site and mitigating the transmission of COVID-19 by employees or workers of Contractor and its subcontractors in their contacts with City employees and consultants. Prior to the pre-construction meeting, the Contractor shall submit to the City a "COVID-19 Mitigation Program" implementing these requirements and shall post the COVID-19 Mitigation Program on the project site in a manner designated by the City's Project Manager. The failure of employees or workers of the Contractor and all subcontractors on the Work to comply with these requirements shall be a default per Section 6-7.1. Contractor acknowledges that, in the event that the Engineer suspends the Work as a result of such failure by Contractor or one of its subcontractors to comply with these requirements, City is not responsible for the delay, and the Contractor is not entitled to compensation pursuant to Section 6-4.3. The Contractor shall also pay to the City the costs and expenses incurred by the City resulting from the failure of employees of the Contractor and all subcontractors on the Work to comply with these requirements including, but not limited to, the salaries and benefits for City employees who are unable to work, and workers compensation benefits and expenses. Delays in the Work resulting from Contractor's or its subcontractor's failure to comply with these regulations shall not be considered an unforeseen event entitling Contractor to an extension of time or payment for delay pursuant to Section 6-4 of the Standard Specifications. It is the bidders sole responsibility to contact the City's online bid management provider to resolve any technical issues related to electronic bidding, including (but not limited to) registering as a vendor, updating passwords, updating profiles, uploading/downloading documents, submitting an electronic bid, etc. Protest Procedures: Pursuant to Chapters 3.28.350 and 3.32.060 of the City of Temecula Municipal Code, any actual or prospective bidder, proposer, or contractor (collectively "bidder") who believes he or she has been aggrieved in connection with the solicitation or award of a contract pursuant to this Chapter may protest, in writing, to the Office of the City Clerk, within three (3) business days after posting of the award recommendation at the location where bids or proposals are submitted. Protest Procedures (Continued): Said bidder shall refer to Chapter 3.28.350 and 3.32.060 of the Temecula Municipal Code for detailed filing requirements. The City's municipal code can also be accessed online at website. SB854: No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5. No Contractor or subcontractor may be awarded a contract for public work unless registered with the DIR pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring & enforcement by the DIR.
