Site work and paving for a road / highway in Live Oak, California. Completed plans call for site work for a road / highway; and for paving for a road / highway.

Work Description: The work to be done under this Contract consists of rehabilitation of Pennington Road from Connecticut Avenue to Broadway, including roadway excavation, imported fill, curb, gutter and sidewalk, pavement markings, curb ramps, and hot mix asphalt paving. Work shall be completed within 90 working days after issuance of a Notice to Proceed by the Owner. The contractor is to carefully examine the site of the proposed work, and is to make his or her own determination of the scope of the work to be performed, including but not limited to the soil conditions and/or groundwater conditions to be encountered in performing the work, and he or she is to carefully examine these Contract Documents. This Project is Subject to the "Buy America" Provisions of the Surface Transportation Assistance Act of 1982 as Amended by the Intermodal Surface Transportation Efficiency Act of 1991 and the Moving Ahead for Progress in the 21st Century Act of 2012. Bid Submittal Requirements: No bid will be accepted unless it is made on a bid form furnished by the City of Live Oak. To ensure consideration, the bid must be enclosed in a sealed envelope, clearly marked Bid which also bears the name of the project and the date and time set for opening of bids. Each bid must be accompanied by cash, certified or cashier's check, or bidder's bond made payable to the City of Live Oak for an amount equal to ten percent (10%) of the amount bid, such guaranty to be forfeited should the bidder to whom the Contract is awarded fail to execute the Contract. No Bid will be accepted from a contractor who is not currently licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professions Code. Subcontractors shall also be licensed as required by said code. The City of Live Oak hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises (DBE) will be afforded full opportunity to submit bids in response to this invitation. The City of Live Oak has established a DBE Goal for this contract of 21%. The contractor shall possess either a Class A license or a combination of Class C licenses which constitutes a majority of the work at the time this contract is awarded. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening. Any such inquiries or questions, submitted after bid opening, will not be treated as a bid protest. No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code Section 1771.1(a)]. No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. PREVAILING WAGES: Pursuant to Section 1770, and following, of the California Labor Code, the successful bidder shall pay not less than the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations. Copies of such prevailing rate of per diem wages are on file at the office of the City Clerk, which copies will be made available to any interested party on request, and are available at the California Department of Industrial Relations Internet web site. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The successful bidder shall post a copy of the applicable wage rates on the job site during the construction period. Attention is directed to the Federal minimum wage rate requirements in the book entitled "City of Live Oak, Sutter County, California, Contract Documents for Pennington Road Rehabilitation Project - West." If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate which most closely approximates the duties of the employees in question. APPRENTICESHIP STANDARDS: In accordance with the provisions of Part 7, Chapter 1, Article 2, Section 1777.5 of the Labor Code of the State of California, the prime contractor shall be responsible for fully complying with the provisions of this Section, as well as any regulations adopted by the Director of Industrial Relations, for all apprenticeable crafts or trades, and shall also assure compliance by his or her sub-contractors with respect to such apprenticeable crafts or trades. INSURANCE AND BONDS REQUIRED: The successful bidder to whom the Contract is awarded will be required to furnish appropriate insurance certificates as required by Section D.1 of the General Conditions and the Special Conditions. He or she shall also furnish a Payment Bond in an amount equal to the total Contract amount and a Faithful Performance Bond in an amount equal to the total Contract amount, with a corporate surety approved by the City of Live Oak. BIDDER'S INFORMATION: Contract Documents, including Plans and Specifications, are available for inspection at the Public Works Department located in City Hall, City of Live Oak, 9955 Live Oak Blvd., Live Oak, California; Valley Contractors Exchange at 951 E. 8th Street, Chico, California; The Contract, if awarded, will be awarded within 30 days after the opening of bids, to the lowest responsible bidder as determined by the City of Live Oak. The City reserves the right, in its sole discretion, to reject any and all bids for any reason whatsoever, or to waive minor irregularities in any bid, and to accept any bid.
