Lincoln Electric System is requesting bids to furnish 12kV Switchgear Building per LES Specification S-22-10 included in this bid solicitation. Successful bidder will be required to complete (1) the LES Equipment Contract, and 2) furnish proof of insurance with coverage specified in the Contract by an insurance company licensed to do business in Nebraska and rated at least B+ in A.M. Bests Rating. Certificate must show LES listed as additional insured for general liability and include waiver of subrogation, 3) furnish a performance and labor and material payment bond from a surety licensed to do business in Nebraska and also rated at least B+ in A.M. Bests Rating. Clarification deadline 9/6/2022 4:00 pm Each bid must include the full name and business address of the bidder and be legibly signed by the bidder. A bid by a firm or organization other than a corporation must include the name and address of each member. A bid by a corporation must be signed in the name of such corporation by the president of the corporation or by an officer of the corporation authorized by it to sign the bid. If any officer other than the president signs the bid, a copy of the corporate authority authorizing the officer to sign the bid shall be attached to the bid. LES may, in its sole discretion, reject any or all bids, or waive minor defects, irregularities, or informalities therein. LES will award the contract to the lowest responsible bidder whose bid best complies with the Contract Documents. At the option of LES, in order to demonstrate its qualifications to perform the work described herein, each bidder shall be prepared to submit, within five days after the bids are opened, a detailed written showing of financial responsibility, relevant similar experience, present commitments, and such other relevant information as may be required by LES. Each bidder shall state in their bid the date upon which the construction project shall be completed. The time required for such completion is hereby made an essential element of the contract. All payments, including progress payments, shall be made by LES in accordance with the Contract. The successful bidder and their subcontractors shall not discriminate against any employee or applicant for employment on the basis of race, color, religion, sex, disability, marital status, national origin, or age. The successful bidder and all subcontractors must agree to abide by the provisions of the Nebraska Fair Employment Practice Act, as found in the statutes of the state of Nebraska, at the time the successful bidder executes the Contract. The successful bidder will be required to execute a contract and bonds as follows: Within ten days after the award of the contract, the successful bidder must execute a written contract between the successful bidder and LES, which contract will incorporate LES specifications. Failure to enter into a contract with LES, on forms provided by LES, within such time period will, at the option of LES, cause a rejection of the bid. The performance bond and construction payment bond, if required by LES, shall cover faithful performance of the contract and payment of all obligations under the contract, in such form as LES may prescribe and with such sureties as LES may approve. The bonds shall be in an amount of not less than the contract price. The bonds must be delivered at the same time that the written contract is delivered by the successful bidder, provided, however, that the Manager, Procurement and Stores may approve in writing an extension of time to a date certain for delivery of the bonds, but in no event, shall work under the contract commence until delivery of the bonds. These bonds shall remain in effect until at least one year after the date when final payment becomes due, unless sooner released by LES. LES shall not incur any liability for any costs incurred by vendors in replying to this solicitation, including any activity related to responding on this solicitation.
