Separate Performance and Material and Labor Payment Bonds equal to one hundred (100%) percent of the contract amount will be required from the successful Bidder upon award of contract. All Bidders and subcontractors shall be properly licensed by the State of South Carolina. Bonding shall be provided if the bid amount is $50,000 or over. The Town reserves the right to suspend a lane closure if the Town's Project Manager deems any resulting traffic backups to be excessive. Unless otherwise indicated in the solicitation, all Work Elements associated with the Small Road Improvement Projects shall be constructed in accordance with the South Carolina Department of Transportation's "Specifications for Highway Construction, latest edition", Standard Drawings for Road Construction, including the Supplemental Specifications, and the Special Provisions, as applicable. Existing pavements are not designed to support all traffic, machinery, and vehicle types. The successful Bidder shall be responsible for any repairs on existing pavement, be it County, private, or State owned; due to damage from construction activities. If it can be proven by the successful Bidder that he was operating within the legal limits, and the damage was not from carelessness or negligence of the Contractor, then he shall not be liable for damages
