PROJECT NO. 3088.21.20 For Install Runway 13/31 Lights and 2-Box PAPIs All proposals will remain on file in the office of the City Clerk at least forty-eight (48) hours before award of contract will be made and entered into thereon. Bids received more than ninety-six (96) hours, excluding Saturdays, Sundays, and holidays, before the time set for opening of bids, as well as bids received after the final time set for receipt of bids, will not be considered and will be returned unopened. No Bidder may withdraw a bid within 90 days after the actual date of opening thereof Bids shall be made in accordance with the Solicitation for Bids, Information to Bidders, Plans and Specifications, and Bidders Proposal, which are on file and available for examination, at no charge, at the office ofthe City Clerk and are made a part of this notice as though fully set forth herein. This project is subject to the following requirements as referenced in the Special Provisions: Buy American Preference (Reference 49 USC 50101) Foreign Trade Restrictions Davis Bacon (Reference: 2 CFR 200 Appendix 11(D)) Affirmative Action (Reference: 41 CFR part 60-4. Executive Order 11246) Government wide Debarment and Suspension (Reference: 2 CFR part 180 (Subpart C), 2 CFR part 1200, DOT Order 4200.5 DOT Suspension & Debarment Procedures & Ineligibility) Government Requirements for Drug-free Workplace No segregated Facilities Requirement (Reference: 41 CFR 60-1.8) All bidders and proposers shall make good faith efforts, as defined in Appendix A of49 CFR Part 26, Regulations ofthe Office of the Secretary of Transportation, to subcontract 5.56 percent of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed to be socially and economically disadvantaged included women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans and Asian-Indian Americans. The apparent successful bidder (proposer) will be required to submit information concerning the DBEs that will participate in this contract. The information will include the name and address for each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract (subcontract). If the bidder fails to achieve that contract goal as stated herein, it will be required to provide documentation demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these requirements will be considered non-responsive. For contracts of $50,000 or more, a contractor having 50 or more employees, and his subcontractors having 50 or more employees and who may be awarded a subcontract of $50,000 or more, will be required to maintain an affirmative action program within 120 days of his commencement of the contract. A Business Relationships Affidavit, Non-Collusion Affidavit, and a cashiers check, a certified check, or a surety bid bond, in the amount of five percent (5%) of the gross amount of bid as a guaranty, shall accompany the sealed proposal of each bidder. Deposits will be returned to the unsuccessful bidders and to successful bidders upon approval of the contract and submission of a 100% Performance Bond, a 100% Statutory Bond, and a 100% Maintenance Bond. On all bids below the amount of $50,000.00, the City of Enid reserves the right to waive any or all bond requirements. The City of Enid reserves the right to reject any and all bids and to waive all informalities.
