Wythe County Board of Supervisors (Owner) is requesting Bids for the construction of the following Project: Wythe County Max Meadows Collection System Improvements Project Thrasher Project #:020-10144. The Project includes the following Work: 1 LS - Mobilization/Demobilization (Maximum 5% of total bid), 1 LS - Pre-Construction Video of Project Area, 1 LS - Erosion & Sediment Control, 120 EA - Remove Existing Frame and Cover and Install New Watertight Frame and Cover (Repair Label A), 28 EA - Apply Epoxy Coat to Interior of Manhole (Repair Label B), 12 EA - Remove Existing Manhole and Install New 48" Diameter Manhole with Watertight Frame and Cover (Repair Label C), 2 EA - Remove Existing Manhole and Install New 48" Diameter Manhole with Vented Frame and Cover (Repair Label D), 25 EA - 6-inch Grade Ring (Repair Label E), 10 EA - 3-inch Grade Ring (Repair Label F), 20 EA - Repair Existing Vent Pipe (Repair Label G), 150 EA - Manhole Frame Anchor Kit Complete (Repair Label H), 25 EA - Install New Clean Out Cap, 1 EA - Replace Existing Clean Out with New Clean Out Assembly, 25 EA - Install Cast Iron Clean Out Cover, 1 LS - Max Meadows Lift Station Wet Well Rehabilitation, 1 LS - Hagers Spring Road Lift Station Wet Well Rehabilitation, 1 LS - Blue Sky Lift Station Wet Well Rehabilitation, 1LS - Chapman Road Lift Station Wet Well Rehabilitation, 1 LS - Reclamation of Disturbed Area (Seeding and Mulching), 20 VF - 48" Diameter Manhole Riser, 50 TN - Gravel Driveway Repair, 64 CF - Concrete Pavement Repair 64 CF - Asphalt Pavement Repair, 32 EA - Manhole Protection (complet. Bids are requested for the following Contract: Wythe County Max Meadows Collection System Improvements Project The Work will be substantially completed within 180 calendar days after the date when the Contract Times commence to run, and completed and ready for final payment within 225 days after the date when the Contract Times commence to run. Liquidated damages shall be $1,000.00 per day. A two envelope system will be used. Envelope No. 1 must have the following information presented on the front: Name and address of Bidder. Bid on Contract - Wythe County Max Meadows Collection System Improvements Project Received by the Wythe County Board of Supervisors Envelope No. 2 labeled "Bid Proposal" shall also be placed inside of Envelope #1. Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR - 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 "Bid Proposal", will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 "Bid Proposal" will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder. Bidders on this work will be required to comply with the President's Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications. Bidders do not or will not maintain or provide for their employees any facilities that are segregated based on race, color, creed, or national origin. Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid. The bidder agrees to make "good faith efforts" to sub-contract a portion of the total value of the contract to disadvantaged businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 31.36(e). Failure to demonstrate positive efforts to do so may lead to rejection of bids. For the purpose of this program, the term "subcontractor" includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. Bidders on this work will be required to comply with the President's Executive Order No. 12138 and 11625. The requirements for bidders and contractors under this order are explained in the specifications. The Contractor and any subcontractors shall not, on the grounds of race, color, or national origin, or sex, exclude from participation in, deny the benefits of, or subject to discrimination, any person under any program or activity receiving federal financial assistance. The contractor and its subcontractors shall comply with provisions of the Davis-Bacon Act and Related Acts. Federal minimum wage laws are applicable to all construction contracts in excess of $2,000. The Davis-Bacon Act stipulates that all laborers and mechanics employed by the contractor or subcontractors on federally assisted projects shall be paid wages at rates not less than those prevailing on similar construction in the area as determined by the Secretary of Labor. The contractor and its subcontractors shall comply with provisions of the Contract Work Hours and Safety Standards Act generally applicable to any contracts in excess of $100,000. Wage rates specified in the applicable wage determination (Attachment 4) for this construction trade and geographic area are required as part of this contract. The wage determination(s) must be posted at the site of the work in a prominent and accessible place. The contractor will also post the Department of Labor poster "Employee Rights under the Davis-Bacon Act P.L. 113-76 Consolidated Appropriations Act, 2014 (ACT), includes an "American Iron and Steel" (AIS) requirement in section 436 that requires Virginia Clean Water Revolving Loan Fund (VCWRLF) and Drinking Water Revolving Loan Fund (DWRLF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works. A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to Wythe County Board of Supervisors in an amount equal to five percent (5%) of the base bid. Contractor is required for every contract over $10,000 the contractor must maintain a drug-free workplace. During the performance of this contract, the contractor agrees to (i) provide a drug-free workplace for the contractor's employees; (ii) post in conspicuous places, available to employees and applicants for employment, a statement notifying employees that the unlawful manufacture, sale, distribution, dispensation, possession, or use of a controlled substance or marijuana is prohibited in the contractor's workplace and specifying the actions that will be taken against employees for violations ofsuch prohibition; (iii) state in all solicitations or advertisements for employees placed by or on behalf of the contractor that the contractor maintains a drug-free workplace; and (iv) include the provisions of the foregoing clauses in every subcontract or purchase order of over $10,000, so that the provisions will be binding upon each subcontractor or vendor. If a Contract for one hundred twenty thousand dollars ($120,000) or more is bid, or if the total value of all construction, removal, repair, or improvements undertaken by the bidder within any twelve-month period is seven hundred fifty thousand dollars ($750,000) or more, the bidder is required under Title 54.1, Chapter 11, Code of Virginia (1950) as amended, to show evidence of being licensed as a "Class A Contractor". If a contract of ten thousand dollars ($10,000) or more but less than one hundred twenty thousand dollars ($120,000), or if the total value of all construction, removal, repair, or improvements undertaken by the bidder within any twelve-month period is one hundred fifty thousand dollars ($150,000) or more, the bidder is required to show evidence of being licensed as a "Class B Contractor". Subcontractors shall also have the appropriate license depending upon the value of work performed. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders. The Wythe County Board of Supervisors reserves the right to reject any and all bids. For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents.
