Site work and paving for a mixed-use development in Belleville, New Jersey. Completed plans call for site work for a road / highway; for paving for a road / highway; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.
All work on this contract shall be completed within Three Hundred Sixty Five (365) calendar days. The Scope of work for this Contract includes, but is not limited to, concrete sidewalk, concrete driveway, curb ramps, asphalt milling and re-paving, earthwork and site restoration, customer and client communication, removal of existing service lines, and installation of copper service lines. Contract Documents and drawings for the proposed work, which have been prepared by the Township Engineer, Thomas J. Herits, P.E, P.P., P.L.S., of the firm Colliers Engineering and Design, are available to prospective bidders upon formal request via e-mail. Proposals must be made on the standard Proposal Forms in the manner designated in the Contract Documents, must be enclosed in sealed envelopes bearing the name and address of the Bidder, and the name of the work on the outside; addressed to Mayor and Council, Township of Belleville. A person bidding on a contract for the erection, alteration or repair of a public building, structure, facility or other improvement to real property, the total price of which exceeds $100,000, shall furnish a guarantee as provided for herein. A contracting unit may provide that a person bidding on any other contract, advertised in accordance with law, shall furnish a guarantee as provided for herein. The guarantee shall be payable to the contracting unit so that if the contract is awarded to the bidder, the bidder will enter into a contract therefor and will furnish any performance bond or other security required as a guarantee or indemnification. The guarantee shall be in the amount of 10% of the bid, but not in excess of $20,000.00, except as otherwise provided herein, and may be given, at the option of the bidder, by certified check, cashier's check or bid bond. In the event that any law or regulation of the United States imposes any condition upon the awarding of a monetary grant to any contracting unit, which condition requires the depositing of a guarantee in an amount other than 10% of the bid or in excess of $20,000.00 the provisions of this section shall not apply and the requirements of the law or regulation of the United States shall govern. All bids shall be in conformity with N.J.A.C. 7:22-3.17f with a goal of not less than 10% participation of small business enterprises and controlled by socially and economically disadvantaged individuals (SED's). Further details regarding required SED participation is included in the Information for Bidders and the Supplemental General Conditions. This contract or subcontract is expected to be funded by in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies, or employees is, or will be a party to this contract or subcontract or any lower tier contractor or subcontract. This contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a) 24 and 4.17(a) 24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. The award of the contract for this project will not be made until the necessary funds have been provided by the Township of Belleville in a lawful manner. The Township of Belleville or the Engineer reserves the right to require a complete financial and experience statement from prospective bidders showing that they have satisfactorily completed work of the nature required before furnishing proposal forms or specifications, or before awarding the Contract. Proposals for this Contract will be accepted only from bidders who are properly qualified in accordance with the requirements of the Contract Documents. The contract will be awarded to the lowest responsible bidder in accordance with N.J.S.A. 40A.11-16(c). The right is also reserved to reject any or all bids or to waive any informalities where such informality is not detrimental to the best interest of the Township of Belleville. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Specifications. The successful bidder shall be required to comply with the following: A. Affirmative Action requirements (P.L. 1975, C.127, N.J.S.A. 10:5-1 et. seq.). B. The provisions of the New Jersey Prevailing Wage Act Chapter 150 of the Laws of 1963, effective January 1, 1964, and the Davis-Bacon Federal Wage Requirements and N.J.S.A. 34:11-56.25 et. seq. C. Anti-Kickback Regulations under Section 2 of the Act of June 13, 1934, known as the Copeland Act. D. Worker and Community Right-to-Know Act (N.J.S.A. 34:5A-1). Copies of the bidder's Public Works Contractor Registration pursuant to P.L. 1999, C. 238 and the Business Registration Certificate pursuant to P.L. 2004, C. 57 must also be submitted with bid. Moreover, the bid must be accompanied by a list of names and addresses of all stockholders owning 10% or more of the stock in accordance with the provisions of the Public Disclosure Law (P.L. 1988, C.33, N.J.S.A. 52:25-24.2).
