All Bidders shall provide a Bid Bond in the amount of Five Per Cent (5%) of their respective Bid for this Project. Non-Consideration of Bids: Bids received after the time set for delivery of bids will not be considered and will be returned unopened. It is the Owner's intent, upon receipt of an acceptable bid, that the contract will be awarded Within forty-five (45) days after opening of bids and the written contract executed within ten (10) days thereafter. The executed contract will not be returned until after receipt of the bonds and insurance, and the several completed certification documents found in the bidding documents. Complete sets of the Drawings, Specifications and other bidding documents may be procured by prime bidders at the Sac and Fox Nation Property & Procurement Department. A cashier's check, certified check or surety bond in the amount of five percent (5%) of the bid shall accompany the sealed proposal of each bidder. Checks or surety bonds will be returned to unsuccessful bidders. Prior to execution of the Contract, the Bidder to whom the Contract is awarded will be required to furnish bonds as follows: 1. Statutory Bond - 100% of Contract Amount 2. Performance Bond - 100% of Contract Amount 3. One Year Defect Bond - 100% of Contract Amount By submitting a bid, Bidders agree and promise to comply with the applicable Federal laws and regulations, including: 1. Davis Bacon Act, 40 U.S.C. 276 a US Department of Labor Regulations (29 CFR Part 3) (prevailing wage rate), 2. providing the prevailing wage rate in the bid proposal, and 3. providing certified payroll as a condition of payment 4. providing evidence that all material men and suppliers have been paid and all claims have been released. The Sac and Fox Nation reserves the right to waive any irregularities or informalities and to reject any or all proposals. Indian Preference provided. The project is not sales-tax exempt.
