Discretionary rejection The PUBLIC BODY reserves the right to reject the Bid of a BIDDER who, in the TWO (2) years preceding the opening of the Bids, has: (a) is the subject of an unsatisfactory performance evaluation by the PUBLIC BODY; b) failed to respond to a tender or a contract from the PUBLIC BODY; Where (c) is the subject of a termination of contract with the PUBLIC BODY because of its failure to comply with its conditions.
