1. This bid is subject to M.G.L. 30B and the statutory requirements for the bidders and the Authority are incorporated herein. 2. RFP Responses must include: o RFP Response Form signed o Respondent may reference supporting materials and documentation for questions on RFP Response Form. Responses will be used in evaluation criteria for experience and capacity to complete the work described in the RFP. o RFP Response Form Attachment I: Non-Collusive and Tax Compliance Affidavit signed and notarized. o Schedule of Hourly Rates for all personnel to be engaged in project o Comments on Proposed form of Contract 3. Any addenda to this bid must be acknowledged in the space provided on the RFP Response Form. 4. It is the bidder's responsibility to fully inform himself/herself of the conditions and requirements relating to the performance of the work specified. Failure to do so will not relieve a successful bidder of his/her obligation to fully carry out and implement all provisions of the contract 5. Bids must be received no later than the date and time specified in the Invitation for Bid. It is the bidder's sole responsibility to ensure timely delivery of the bid. Late bids will be considered non-responsive and be returned unopened. 6. Any bid may be withdrawn prior to the time designated for receipt of bids on written or telegraphic request. Telegraphic withdrawal of bids must be confirmed over the signature of the Bidder by written notice post-marked on or before the date and time set for receipt of bids. 7. No bid may be withdrawn within 60 calendar days after the opening of bids. 8. The Brookline Housing Authority reserves the right to waive any informalities in or to reject any or all bids. 9. Unless otherwise specified herein, contract award will be made to the most advantageous proposal from a responsible and responsive offer or taking into consideration price and the evaluation criteria set forth in the request for proposals. 10. All applicable federal and state laws, municipal ordinances, and the rules and regulations of all authorities having jurisdiction over the Brookline Housing Authority and the work herein specified shall apply to this bid and ensuing contract throughout, and they will be deemed to be included in the contract as if herein written out in full. 11. To determine resources, ability and integrity, elements considered will include, but not be limited to, whether the bidder: a) maintains a permanent place of business, b) has adequate staffing to do the work properly and expeditiously, c) has a suitable financial status to meet the obligations incident to the work, d) has appropriate technical experience. The Authority reserves the right to request additional information from any bidder in order to evaluate his/her resources, ability and integrity. 12. The Authority reserves the right to reject the bid of any bidder who has previously failed to perform properly, or to complete contracts of a similar nature, who is not in the position to perform the contract, or who has habitually and without just cause neglected the payment of bills or otherwise disregarded his/her obligations to material men or employees. 13. The Authority is prohibited from making any awards to contractors or approving individuals or firms which are on lists of contractors ineligible to receive awards from the United States, as furnished from time to time by HUD, and/or are debarred from bidding under Massachusetts Law. 14. Bidders requiring clarification or interpretation of the Contract Documents shall make a written request to the BHA and the BHA will answer such requests if received seven (7) calendar days before the date for receipt of the responses. 15. Interpretation, correction, or change in the Contract Documents will be made by written Addendum which will become part of the Contract Documents. The Housing Authority will be liable for any oral interpretations, corrections, or changes.
