It is the intent of these Supplemental Special Provisions to provide for the necessary Work including but not limited to sawing, pavement removal, base repair, cold milling, resurfacing, or other work described, to obtain a permanent repair of the existing paving. These Supplemental Special Provisions apply only to Annual Unit Price Contracts for citywide public improvements. Where in conflict with the other specifications, these Supplemental Special Provisions shall govern. The City may reject a Bid if it is mathematically or materially unbalanced. The City considers a Bid mathematically unbalanced if the Bid contains items as lump sums or unit prices that do not reflect reasonable estimated costs plus reasonable proportionate share of the Bidder's anticipated profit, overhead costs, and other indirect costs. The City considers a Bid materially unbalanced if that Bid, as a whole, creates a reasonable doubt that award to the Bidder submitting a mathematically balanced Bid will not result in the lowest cost to the City. The City may award public construction contract(s) to the lowest and best competitive bidder(s), for multiple Citywide public street improvement projects. The City may award public construction contract(s) to the lowest and best competitive bidder(s), if each bidder qualifies under these Supplemental Special Provisions and the City Council determines that it is in the best interest of the City to award multiple Citywide public street improvement projects. The City Council will take into consideration that the City Council and the citizens desire to expedite repair and improvement of City streets and that meeting these goals require multiple contracts and contractors to work simultaneously. The Maintenance Bond shall be in favor of Awarding Public Agency and shall be for a period of 1 year from the expiration or termination of the Contract in an amount equal to one hundred percent (100%) of the Contract amount. The Performance Bond and Statutory Bond shall be in favor of Awarding Public Agency and shall be for the term of the Contract will be in an amount equal to one hundred percent (100%) of the Contract amount through the term of the Contract and any renewal thereof. The "Bid Security" is that security submitted with the Bid which shall be in the form of a certified check, cashier's check or Bid Bond equal to five percent (5%) of the Bid or of an irrevocable letter of credit in the amount of five percent (5%) of the Bid and issued in accordance with the provisions of the Public Competitive Bidding Act of 1974, as amended. The calculation of the amount of the Bid Security shall be as provided in Section 4.2.1 of these Instructions to Bidders. Provide the Bid Bond through the Electronic Bidding Process. Irrevocable Letters of Credit, certified check and/or cashier's check must be hand delivered to the Office of the City Clerk, 2nd Floor, Municipal Building, 200 N. Walker Avenue, Oklahoma City, Oklahoma 73102 prior to Bid Time. All potential bidders are responsible to read all Bidding Documents and submit questions in writing through the electronic bidding system by (November 16, 2022 / 12:00:00 pm.)
