Questions Due By: Tuesday, November 15th, 2022 @ 5:00 PM For furnishing all labor, material, tax, transportation, equipment, and services necessary for Job Order Contracts (JOC-032, JOC-033, JOC-034) in accordance with the bid documents and specifications now on file with the District. A bidder may be awarded at most one (1) contract from this solicitation. PROJECT DESCRIPTION: A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor may perform an ongoing series of individual Projects at different locations throughout the District. The bid documents include a Construction Task Catalog(R) containing construction tasks with preset Unit Prices. All Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction. The Contractor will bid two Adjustment Factors to be applied to the Unit Prices. One Adjustment Factor is for performing work during Normal Working Hours, a second Adjustment Factor is for performing work during Other Than Normal Working Hours. The same two Adjustment Factors shall apply to every Pre-priced Task in the Construction Task Catalog. TERM: The Term of the Contract is one year. All Job Orders issued during the term of this Contract shall be valid and in effect notwithstanding that the Detailed Scope of Work may be performed, associated Supplemental Job Orders may be issued, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each Job Order. MINIMUM AND MAXIMUM CONTRACT VALUES: The Minimum Contract Value for each Contract is $50,000. The Contractor is guaranteed to receive the opportunity to perform Job Orders totaling at least $50,000 during the Term of each of the Contracts. The Maximum Contract Value for each Contract is as indicated in the chart to the right. Pending District Board approval, District has the option to increase each contact to the State Maximum allowable by the Public Contract Code Section 20128.5, adjusted annually to reflect the percentage change in the California Consumer Price Index since January 1998, which at this time is approximately $5,402,866. Contractor is not guaranteed to receive the Minimum Contract volume of Job Orders. The District has no obligation to issue Requests for Proposals and/or Job Orders in excess of the Minimum Contract Value. LICENSE REQUIRED: B All bids must be accompanied by certified check, cashier's check or bid bond made payable to East Bay Regional Park District in the sum of twenty five thousand dollars ($25,000). The check or bonds shall be given as a guarantee that the successful bidder will enter into a written contract within ten (10) calendar days after being requested to do so and will be considered as the stipulated amount of liquidated damages in the event the bidder is unable to or refuses to execute a contract for the work.
