Instructions to Bidders are included as part of and binding on the Contract that will exist between the Owner and the successful Bidder.The Supplementary Conditions contains changes and additionsto the "General Conditions ofthe Contract for Construction", AIA Document A201,2017 Edition, hereinafter called General Conditions. Where any part ofthe AIA General Conditions is modified or voided by the Supplementary General Conditions, the unaltered provisions shall remain in effect. Submit all questions about the architectural drawings and specifications to the Architect. Submit all questions about the M/E/P drawings to the Engineer. Interpretations or corrections will be issued as Addenda. The Architect and Owner will not be responsible for oral clarification. Questions received less than seventy-two hours before the bid opening cannot be answered.Should there be errors, discrepancies, ambiguities, or omissions in the Contract Documents, Bidders shall notify the Architect immediately. The Architect shall issue a written addendum simultaneously to all Bidders. Only a written interpretation or correction by addendum shall be binding.All addenda shall become a part of the Contract Documents and receipt ofthe addenda shall be indicated on the Bid Form. List the addenda received in the space provided on the Bid Form. The Owner may award a contract to the Contractor ofhis choosing. The Contract form to be used will be the "Standard Form of Agreement Between Contractor and Owner", AIA Form Al01, 2017 Edition. The Bidder acknowledges the right ofthe Ownerto rej ect any or all bids and to waive any informality or irregularity in any bid received and to select the Contractor which is most appropriate to the job requirements.In addition, the Bidder recognizes the right ofthe Owner to reject a bid ifthe Bidder failed to furnish any required bid security, or to submit the data required by the bidding documents, or ifthe bid is in any way incomplete or irregular. A bid without bid security will not be read. Bidders must be pre-qualified forthis project by meeting all specified requirements, as well as having been in business underthe current form ofownership for a minimum ofthree (3) years. (Does not include reorganization among existing owners with minimum three yearsexperience with similar contracting. Bids shall be submitted in duplicate by the Bidder on the Bid Form supplied by the Architect. Bidders shall not submit bids on any other form. The Bid Form shall be filled out completely including Base Bid and all Alternate Bids. No bid shall be withdrawn for a period of 60 days after opening of bids without the consent ofthe Owner. Bids must be exact in amount and firm. Work shall start June 1, 2023, and be substantially complete by August 1, 2023. A bid guarantee consisting of a bid bond, certified check or cashier's check in the amount often percent (10%) ofthe amount ofthe Base Bid shall be submitted with each bid and bidder hereby agrees that the proceeds ofsuch bid bond, check or draft shall become the property ofthe Board of Education, Dallas Elementary School District #327, if for any reason the bidder, within sixty (60) days after official opening of bids, withdraws his bid or ifon notification ofaward refuses or is unable to execute tendered contract and provide an acceptable performance bond within ten days after such tender.Security shall be held only by bid bond issued by surety licensed to conduct business in the State ofIllinois, or certified or cashier's check made payable to the Owner.
