The Beaver and Fremont River Ranger Districts are proposing to authorize a special use permit to both Circleville Town and Torrey Town to improve their culinary water systems. The Circleville portion of the project includes redeveloping the existing spring, replacing the existing water transmission line, installing a gate and fence to limit motorized access to site, and widening the existing access road. The Torrey portion consists of installing a new water tank with associated infrastructure and replacing the existing waterline that services Sleeping Rainbow Subdivision. During a preliminary assessment, Fishlake National Forest officials find this proposal lies within categories that can be excluded from documentation and that no known extraordinary circumstances exist that preclude exclusion. The proposed action is a routine activity as defined in FSH 1909.15 Section 32.2 and fits Category 36 CFR 220.6(e)(3): "Approval, modification, or continuation of special uses that require less than 20 acres of National Forest System (NFS) lands." The USDA Forest Service (USFS) is no longer required to offer notice, comment, and appeal opportunities pursuant to 36 CFR 215 or 36 CFR 218 for categorically excluded projects. However, such legislative ruling does not limit the public's ability to comment on USFS projects and activities. By soliciting public comments, the USFS ensures that a wide range of interests and perspectives are considered and that site-specific natural resource concerns are identified. Comments received in response to this proposal, including names, addresses, and any other information provided with the comments, will be considered part of the public record and will be subject to the Freedom of Information Act and released if requested.
