For Municipal Sanitation Services Agreement No bid may be withdrawn for a period of thirty days after the date set for opening thereof. The Town of Bar Nunn reserves the right to reject any or all bids, and to waive any informalities or technicalities in the bidding; provided, however, that any bid received after the time specified as stated below, will not be considered. The successful Bidder will be required to execute an Agreement with the Town of Bar Nunn, in the form supplied in the bidding documents, within thirty days after Notice of Award is issued. The Notice of Award shall serve as notice that the Agreement is ready for execution. The Bid Guaranty shall be forfeited as liquidated damages if the bidder fails to execute the Agreement within thirty days after such notice is issued or fails to provide proper Bond or other form of Guaranty, as approved. No other type of Bid Guaranty will be accepted. The Town of Bar Nunn may proceed against a Bid Guaranty unless either: a) the Agreement has been executed by Contractor; and Performance, and Labor and Material Payment Bonds have been furnished, as required; or b) the specified time elapsed so that Bids may be withdrawn; or c) the bid has been rejected. In general, the following shall be required of bids The winning bidder shall provide at a minimum sanitation service to the residents of the Bar Nunn as set forth below. a. Bidder shall furnish to each resident one (1) polycart/toter assigned with a serial number to be noted at each address. Each such polycart/toter shall be emptied by Bidder once per week. For each such residence Bidder will also pick up a maximum of three (3) extra tightly tied trash bags per week. b. Upon being informed by Bar Nunn of a new residence coming into existence after the effective date of this Agreement, Bidder shall provide the new residence with one (1) ninety-six (96) gallon toter. c. Bidder will replace all the polycarts/toters, within a reasonable timeframe when they have been damaged beyond repair. d. Bidder, in keeping with the requirements of the City of Casper Regional Landfill, will not accept any fluids, iron, tires, hazardous materials, ashes, and/or building materials in the toter. e. Bidder will pick up all clean used motor oil free of charge, provided that it is in a closed container suitable for liquids and placed next to the toter and not within it. f. The Town Clerk for Bar Nunn shall inform Bidder of any residence that has failed to pay their sanitation bill and which is delinquent in excess of thirty (30) days. Upon such notification, Bidder shall remove the polycart/toter at said residence and shall not pick up any refuse until such bill is paid in full and notification of the same provided to Bidder by the Town Clerk. g. In the event of a mechanical failure of the trash trucks impacting the ability to pick up the refuse, the same which is acknowledged to happen from time to time, and the refuse is unable to be picked up on its regularly scheduled date and/or approximate time, Bidder will collect the refuse within a timely manner directly following the resolution of said mechanical failure, but in no event a period longer than two weeks from the failure. h. The agreement shall not be assignable.
