Renovation of a mixed-use development in Salem, Oregon. Completed plans call for the renovation of a educational facility.

The project consists of demolition of existing and replacement with new rooftop HVAC units at the WESD Marion Center (2611 Pringle Road Southeast; Salem, Oregon 97302) as shown on the drawings and as specified. In accordance with State Law, Willamette Education Service District uses and incorporates the Oregon Attorney Generals Model Public Contract Rules (Oregon Administrative Rules) Chapter 137, Division 46, Division 47, Division 49, and Division 40 (Public Improvements) into contract documents related to this project. C. Vendors shall use recyclable products to the maximum extent economically feasible in the performance of the contract work set forth in this document. Bidder shall specify the minimum, if not exact, percentage of recycled paper in paper products or recycled product in products offered, and both the post consumer and secondary waste content regardless of whether the product meets what percentage of recycled material respecified for recycled paper or recycled products in ORS 279A.010 and ORS 279A. For paper products the bidder shall also specify the fiber type. The contractor may certify a zero percent recycled paper or product. A. No bid will be considered unless fully completed in the manner provided in the "Instructions to Bidders" upon the bid form provided by the Architect and accompanied by a bid bond, cashiers check or certified check executed in favor of Willamette Education Service District; Salem, Oregon in an amount not less than 10% of the total amount of the bid. Bid bonds will be accompanied by power of attorney bearing the same date as the bond. Bid bond, cashiers check, or certified check to be forfeited as a fixed and liquidated damage should the bidder neglect or refuse to enter into a contract and provide suitable bond for the faithful performance of the work in the event the contract is awarded to them. FACSIMILE/ELECTRONIC COPIES OF THE ABOVE MENTIONED DOCUMENTS SHALL BE REJECTED. B. The successful bidder will be required to furnish a performance and labor & material bond in the amount of one hundred percent (100%) of the Contract as security for the faithful performance of this contract and as security for payment of all persons performing labor under this contract and furnishing materials in connection with this contract. FACSIMILE/ELECTRONIC COPIES OF THE ABOVE MENTIONED DOCUMENTS SHALL BE REJECTED. The first tier subcontractor list may be submitted with the sealed bid at bid submittal deadline: 2:00 p.m. local time; Thursday December 1, 2022 at the bidders preference. A. The successful bidder and all subsequent subcontractors shall comply with requirements of ORS 279C.800 to 279C.870 and produce appropriate certificates indicating compliance. State law requires contractors must pay the higher of the state Prevailing Wage Rate (PWR) or federal Davis-Bacon rates, even if NO state or local funds are used. See BOLIs comparison rate book referenced in Project Manual specification section 00900 - Prevailing Wage Rates. B. The successful bidder and all subsequent subcontractors shall comply with ORS 656.017, Oregon Workers Compensation Law, and produce appropriate certificates that they have complied. C. All subject employers working under this contract shall either be employers that will comply with ORS 656.0171.6 or employers that are exempt under ORS 656.126. D. The successful Bidder Shall comply with the minimum rates for wages for laborers and mechanics as determined by the Secretary of Labor in accordance with the provisions of the Davis-Bacon and related acts. State law requires the higher of either the State Prevailing Wage Rates or Federal Davis-Bacon rates to be paid to workers on projects in Oregon subject to both State Prevailing Wage Rate law and Federal Davis-Bacon Wage Rate Act. RESIDENT BIDDER A. Willamette Education Service District will not consider a bid proposal unless it contains a statement as to whether a bidder is a resident bidder as defined in ORS 279A.120. CONTRACTOR REGISTRATION A. Willamette Education Service District will not consider a bid proposal unless it contains a statement by the bidder that they are certified/registered with the Oregon Construction Contractors Board, in accordance with ORS Chapter 700. NON-COLLUSION AFFIDAVIT A. All Bidders shall certify on the Bid Form their bid has been arrived at by the bidder independently and has been submitted without any collusion designed to limit independent bidding or competition. All Bidders shall certify on the Bid Form no member, officer, or employees of Willamette Education Service District or its designees or agents, no member of the governing body of Willamette Education Service District and no other public official of Willamette Education Service District exercises any functions or responsibilities with respect to this contract during his/her tenure or for one year thereafter, shall have any interest, direct or indirect, in work to be performed in connection with this contract. All contractors shall incorporate, or cause to be incorporated, in all subcontracts a provision prohibiting such interest. Willamette Education Service District will not consider a bid proposal unless it contains a non-collusion affidavit, part of the Bid Proposal form, signed by the bidder. LOWEST RESPONSIBLE BIDDER A. In determining the Lowest Responsible Bidder Willamette Education Service District will utilize standards of responsibility as outlined in ORS 279C.375. This may include referencing the Oregon Construction Contractors Board (CCB) Web Site to determine, Contractors Not Qualified to Hold or Bid Upon Public Contracts or Public Improvement Projects. The Internet URL for the CCB Home Page RIGHTS OF WILLAMETTE EDUCATION SERVICE DISTRICT A. It is the intent of Willamette Education Service District to award a Contract to the lowest responsible Bidder(s) provided the Bid has been submitted in accordance with the requirements of the Bidding Documents and does not exceed funds available. Willamette Education Service District shall have the right to waive informalities or irregularities in Bids received and to accept Bids which, in Willamette Education Service Districts judgement, is in Willamette Education Service Districts own best interests.
