If a bid is submitted on an article intended as a substitute for a grade or brand specified, the vendor shall state the grade or brand of the substitution, otherwise it will be assumed that the bid is based upon the grade or brand specified. The Board reserves the right to accept this bid by items, or as a whole, or to reject any and all bids or waive informalities. Bid prices are to be shown NET. Cash discounts, if any, are to be clearly stated. Prices must be filled in mechanically or in ink on this form and placed ina SEALED ENVELOPE CLEARLY MARKED WITH THE BID NUMBER AND THE NAME OF THE VENDOR SUBMITTING THE BID. Any and all bids and contracts made or awarded by the Board, or any department, agency or official thereof for work or : services performed or to be performed, or goods purchased or sold or to be purchased or sold are made subject to the | provisions of Chapter 861 of the Laws of New York, 1953, as amended by Chapter 751 of the Laws of New York, and as : now contained or may hereafter be amended. The provisions of the New York State General Municipal Law, including | Sections 103a and 103b, are applicable to this bid. Vendors attention is requested regarding the following conditions and regulations. Bids not in compliance with the conditions and regulations contained herein will not be considered non-collusive bidding certification (pursuant to chapter 751 of the laws of New York, 1965) The term of this solicitation is for a period of one (1) year, commencing on January 1, 2023 and ending December 31, 2023. Bid prices must remain firm for a period of six (6) months, from January 1, 2023 through July 1, 2023. For deliveries on or after July 1, 2023, the base bid price may be adjusted up (but shall! not be decreased in the event of a negative percent change) in accordance with the index percentage change of the Producer Price Index (PPI) noted below over the period from the December 2022 PPI data published on or before December 20, 2022 compared with the June 2023 PPI data published on or before June 20, 2023, not seasonally adjusted. The PPI data set to be used for this calculation is as follows: Commodity data for Chemicals and Allied Products: Chlorine, Sodium Hydroxide, and Other Alkalies, not seasonally adjusted (WPU 06 130302): PPI data can be obtained from the BLS Websitw by emailing the PPI at ppi- info@bls.gov, or by calling (202) 691-7705. PPI data are typically published between the 9th and the 16th of the | month following the reference month in question. On or before June 30, 2023, bidder shall notify the Water Board via an email to Chief Operator Dennis Kirkland at dkirkland@NFWB.org of the percent change in the PPI as noted above and of bidders calculation of the new bid price.
