The purpose of this project is to provide invasive species treatment at Russian Ridge and Coal Creek Open Space Preserves. The scope of work shall include vegetation management techniques that include manual, mechanical, and/or limited chemical (herbicide application) treatment of encroaching scrub species and selected California Invasive Plant Council (Cal-IPC) listed species, as further detailed and described herein as the Contract Documents. The lands within the District's boundary are located along the San Francisco Peninsula between the Pacific Ocean and the San Francisco Bay, extending from San Carlos in San Mateo County in the north to the unincorporated Santa Clara County area located south of Los Gatos in the south. Individual treatment sites for this project will occur at Russian Ridge and Coal Creek Open Space Preserves which are located adjacent to Highway 35 approximately 4 miles south of the town of Woodside (Exhibit 1: Project Specific Site Map). Award of Contract is anticipated to occur on January 13, 2023. On site activities cannot commence prior to January 23, 2023, by which date contractor must have obtained all requisite permits and complied with all pre-construction submittal requirements. On weed treatment activities are anticipated to take approximately four years. Project must be substantially complete no later than June 30, 2023. All work associated with treatment of weeds, such as, but not limited to preparation of herbicides and adjuvants, preparation of necessary equipment and labor, travel to and from work site, posting and removing Herbicide Notification Signs, reporting to the District via Calflora, and filing of necessary pesticide reports to the county are assumed to be included in the rate items of the base bid. For the treatment bid items, contractor will be reimbursed only for the number of hours actually worked on the preserves treating weeds. Due to the dynamic nature of invasive species treatment, estimated hours are provided, but may change depending on several factors outside the control of the selected contractor and/or District. The Project Budget is $40,000. Contractors who bid on this project should expect that the District may change the number of hours to add or deduct work from the scope of work at District's discretion to meet the project budget. Prior to submitting their proposals, Bidders shall thoroughly examine the Contract Documents and shall participate in the mandatory pre-bid walk to understand the site conditions and scope of Work. Any questions, concerns, errors or ambiguities noted by the Bidder during said examination shall immediately be called to the attention of the District Representative prior to a submission of a bid. The District will issue addenda with interpretation of the cited questions, concern, error or ambiguity. No subsequent claim for extra work will be allowed on account of claimed misunderstanding of the meaning or intent of the Contract Documents, site conditions, or any other documents included in this Bid Package if the item occasioning the claim appeared in, or was inferable from, said documents or from site investigations mandated for bidding purposes. Examination of Site Attention is directed to Bidder's obligation to examine the Work site; compare the site with the Plans and Specifications; determine any site variation that affects the Bid; and investigate the conditions of existing clearances, restrictions, or limitations that affect access to the Work. Bidder's failure to do any and all of the above shall not be a basis for claim of additional monies or extension of time. Examination of Contract Documents Bidder shall examine the Contract Documents to verify that there are no missing pages or sheets and shall obtain and examine any and all missing material prior to submitting the Bid. Contract Documents Addenda Explanations or interpretations will be made by District in the form of addenda to the documents and furnished to all bidders. Oral explanations and interpretations made prior to the Bid opening shall not be binding. All questions to the District must be made by the General Contractor. No questions from proposed Subcontractors will be received. Written addenda modifying Bid Package documents will be emailed, mailed or faxed to the Builders Exchanges listed above and to all prospective Bidders that attend the pre-bid meeting or otherwise submit a written request for notice of addenda. Under California Business and Professions Code 7000 through 7145, commonly known as the "Contractor's License Law", Contractor must possess an appropriate license that is current and valid at the commencement of and throughout the Term of the Agreement for the Work. The License required for this Agreement is C-27, Landscaping Contractor. All subcontractors must possess an appropriate license that is current and valid at the commencement of and throughout the Term of the Agreement. In addition, the Contractor must possess a current and valid Pest Control Business License (PCB) and Qualified Applicator License (QAL) at the time of bid submittal and throughout the term of the Contract with qualifications in at least one of the following: Landscape Maintenance (Category B); or Plant Agriculture (Category D). Contractor will be required to register with San Mateo, Santa Clara, and Santa Cruz Counties. All subcontractors must possess an appropriate license that is current and valid at the commencement of and throughout the Term of the Agreement. The successful Bidder shall obtain and maintain in full force, workers compensation insurance (California Labor Code 1860 & 1861) and commercial general liability and automobile insurance as further described in the Agreement. Bond and Insurance requirements are further described in the Agreement. The District reserves the right to reject any or all Bid Proposals, to waive any informality, minor technical defect, or irregularity in Bid Proposals, and to accept or reject any items of a Bid Proposal. The District, at its discretion, may reject as incomplete any bid which is in any way conditional, includes exceptions, alterations or omissions, or includes reservations to the terms of the Bid Proposal form, drawings, specifications, or other contract documents. The District reserves the right to reject any and all bids. District will reject bids from any contractor for whom there is documented evidence of project schedule delays and cost overruns and / or documented inability to meet project performance requirements. The Project Budget is $40,000. Contractors who bid on this project should expect that the District may change the number of hours to add or deduct work from the scope of work at District's discretion in order to meet the project budget. The contract will be awarded to the lowest Responsible Bidder, as defined above under Responsive Proposal considering the following factors: If the lowest Total Base Bid is equal to or less than the Project Budget (as stated in Instructions to Bidders), the contract will be awarded to that Bidder; If the lowest Total Base Bid is greater than the Project Budget, that Bidder may be awarded the contract, or, all Bids may be rejected, at the sole discretion of the District; In the event of a tied low bid, the award would be based on a coin toss or equivalent random selection process; The District reserves the right to reject any or all of the Bids at its sole discretion.
