NOTICE IS HEREBY GIVEN that the Irvine Unified School District of Orange County, California, acting by and through its Governing Board, hereinafter referred to as DISTRICT, has determined that all bidders for the Measure E Series 3 Irvine HS Performing Arts Complex Increment 02 (Project) must be prequalified in accordance with Public Contract Code section 20111.6 prior to submitting a bid on the Project. Any contractor that has not prequalified on a DISTRICT project in accordance with Public Contract Code section 20111.6 within the past twelve (12) months and is interested in bidding on the project, must submit a Prequalification Questionnaire Package online to PQBids by the date and time indicated herein. Any contractor that has prequalified with the District in accordance with Public Contract Code section 20111.6 within the past twelve (12) months may satisfy the prequalification requirements for this project if its earlier Prequalification Questionnaire package was approved for the same or appropriate license requirement, and the contractors total base bid and alternates amount for this Project does not exceed their prequalified bid amount which is equal to fifty percent (50%) of the contractors bonding capacity. Otherwise, the contractor must submit a fully completed and sealed Prequalification Questionnaire Package to the DISTRICT to be eligible for prequalification for this project. Bidders are solely responsible to verify with the DISTRICT whether they are properly prequalified to submit a bid for this Project. Since this Project includes work that will be performed by mechanical, electrical, or plumbing (MEP) contractors (contractors that require C4, C7, C10, C16, C20, C34, C36, C38, C42, C43, or C46 licenses), such MEP subcontractors must also be prequalified. A list of prequalified MEP subcontractors will be made available by the DISTRICT to all bidders at least five business days prior to the bid opening date. A Contractors bid for the Measure E Series 3 Irvine HS Performing Arts Complex Increment 02 Project WILL NOT be accepted unless the Contractor is properly prequalified. If any bidder is in doubt as to the true meaning of any part of the Project Documents, finds discrepancies in or omissions from the Project Documents, or requests a substitution for materials and equipment as outlined in the specifications, they must submit a written request for an interpretation or correction to C.W. Driver on or before January 20th , 2023 by 5:00 p.m. No requests shall be considered after this time. Each bid shall be accompanied by a bid security in the form of cash, a certified or cashiers check or bid bond in an amount not less than ten percent (10%) of the total bid price, payable to the DISTRICT. The DISTRICT reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding process. All CONTRACTORS and subcontractors must be registered with the DIR to submit a bid proposal for a public works project pursuant to Labor Code section 1725.5. As required by Section 1773 of the California Labor Code, the California Department of Industrial Relations has determined the general prevailing rates of per diem wages for the locality in which the work is to be performed for the Project. Copies of these wage rate determinations, entitled Prevailing Wage Scale, are available at the following website: www.dir.ca.gov. It shall be mandatory upon the successful bidder to whom the contract is awarded, and upon any subcontractor listed, to pay not less than the specified rates to all workers employed by them for the Project. The successful bidder and any listed subcontractor(s) of this Project are subject to the oversight, monitoring and enforcement of prevailing wage requirements by the Department of Industrial Relations, Division of Labor Standards Enforcement, and will be required to submit certified payroll records to the Labor Commissioner. No bidder may withdraw any bid for a period of sixty (60) calendar days after the date set for the opening of bids. Pursuant to Public Contract Code Section 22300, the Agreement will contain provisions permitting the successful bidder to substitute securities for any monies withheld by the DISTRICT to ensure performance under the Agreement or permitting payment of retentions earned directly into escrow. Bidders must meet the specified requirements regarding Disabled Veteran Business Enterprise (DVBE) Programs. DVBE forms and requirements are included in the bid documents.
