For Charter School Septic to Sewer . The Town of Oakland reserves the right to accept or reject, in part or total, any or all bids and to waive any informalities as deemed in the best interest of the Town. All bids must be marked on the outside of the envelope with the bid name, the time and date of opening. It shall be the BIDDER'S responsibility to ensure that proposals are delivered to the above address by the appointed time. Submission of all questions may be sent to Tucker Hunter, P.E., Kimley-Horn, via e-mail at tucker.hunter@kimley-horn.com. All questions must be submitted by 2:00 PM, April 21, 2023 . To begin work not later than 10 days after the issuance of a Notice to Proceed, unless otherwise provided, and substantially complete the work within 90 calendar days of the date of the Notice to Proceed. Each Bid shall be accompanied by Bid Security in the form of a certified check or bid bond in an amount equal to at least five percent (5%) of the Total Bid Price, payable without condition to the OWNER, as a guaranty that the Bidder, if awarded the Contract, will promptly execute the Agreement in accordance with the Bidding Documents, and will furnish Performance and Labor and Material Payment Bonds as specified herein. Within ten (10) calendar days from the date stipulated in the Notice of Award notifying the contractor that its Bid has been accepted, the successful Bidder shall execute the Agreement. Simultaneously with the execution of the Agreement, the Contractor shall furnish a Performance Bond and a Labor and Material Payment Bond, each in an amount equal to 100 percent of the Contract Price. The Bonds shall be secured from a surety company acceptable to the OWNER. The form of bond must be in a form satisfactory to the Town. Failure to execute the Agreement or to furnish required Bonds within ten (10) calendar days from the date of the Notice of Award entitles the Owner to consider all rights arising out of the Owner's acceptance of the Bid as abandoned and the Bid Bond shall be forfeited. The Owner shall be entitled to such other rights as may be granted by law. The price page and other relevant information concerning the bids are read aloud and made a part of the public record of the Town of Oakland. Therefore, it is necessary that the information presented is accurate and that by which the awarded bidder will complete the contract. The Bidder must fill in all relevant blank spaces. Where so indicated by the makeup of the Bid Form, amounts shall be expressed in both words and figures, and in case of discrepancy between the two, the amount in words shall govern. Where a unit price is requested, the Bidder must furnish a Unit Price for all items, regardless of the quantity. In case of discrepancy between the Unit Price and an extended total, the Unit Price shall govern. Except in cases where the OWNER exercises the right to reject all Bids, the Contract will be awarded by the OWNER, after Opening of Bids, to the Bidder who has submitted the lowest responsible and responsive individual or combination Bid. This bid will be awarded as best serves the interest of the OWNER. All awards made as a result of this bid shall conform to all applicable ordinances of the Town of Oakland. To accept the provisions of the Agreement as to liquidated damages in the event of failure to complete the work on time. OWNER and CONTRACTOR recognize that time is of the essence of this Agreement and that OWNER will suffer financial loss if the Work is not substantially complete within the time specified in Paragraph C above, plus any extensions thereof allowed in accordance with the General Conditions. They also recognize the delays, expense and difficulties involved in proving in a legal arbitration proceeding the actual loss suffered by OWNER if the Work is not substantially complete on time. Accordingly, instead of requiring any such proof, OWNER and CONTRACTOR agree that as liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER $500.00 for each calendar day that expires after the time specified in Paragraph C for substantial completion until the work is substantially complete. It is agreed that if this Work is not Finally completed in accordance with the Contract Documents, the CONTRACTOR shall pay the OWNER as liquidated damages for delay, and not as penalty, one-fourth ( 1/4 ) of the rate set forth above. Of liquidated damages payable by the ContractorThe Contractor agrees that said work shall be prosecuted regularly, diligently and without interruption at such rate of progress as will ensure full completion thereof within the time specified. It is expressly understood and agreed, by and between the Contractor and the Owner that the time for the completion of the work described herein is a reasonable time for the completion of the same. If the Contractor shall neglect, fail or refuse to complete the work within the time herein specified, or any proper extension thereof granted by the Owner, then the Contractor does hereby agree as a part consideration for the awarding of this contract to pay to the Owner the amount specified elsewhere in these documents, not as a penalty, but as liquidated damages for each and every calendar day that the Contractor shall be in default after the time stipulated in the Contract for completing the work. It is further agreed that time is of the essence of each and every portion of this contract and of the specifications wherein a definite and certain length of time is fixed for performance of any act whatsoever; and where under the contract an additional time allowed for the completion of any work, the new time limit fixed by such extension shall be of the essence of this contract. Provided that the Contractor shall not be charged with liquidated damages or any excess cost when the Owner determines that the Contractor is without fault and the Contractor's reasons for the time extension are acceptable to the Owner.
