McMullen County, Texas ("County"), acting by and through the McMullen County Commissioners Court ("Commissioners Court"), its governing body, shall accept competitive sealed bids for the following construction project ("Project") to be performed pursuant to a public works contract awarded by the County through competitive procurement procedures authorized by law: the new construction of a cantilevered covered parking area to be constructed along the 200 block of Ash Street, Tilden, Texas. This project consists of the construction of a covered parking area to be located south of the McMullen County Courthouse along Ash Street, between TX Hwy 16 & Main Street. The awning is cantilevered so no supports are located within the parking area, and is approximately 24' x 264'. Along the south side of the support columns is a bioretention area that is approximately 3.5' deep. The public works contract to be awarded for the Project shall be based on a timely submitted sealed bid for lump-sum pricing, and said contract shall require, among other things, that: (a) construction shall be completed timely and in compliance with the County's plans and specifications for the Project, and shall include all materials, equipment, labor, services, and work necessary to finally construct and complete the Project; (b) the Project shall require the execution of a performance bond and payment bond as required by and in compliance with Chapter 2253 of the Texas Government Code, Chapter 262 of the Texas Local Government Code, and other authority; (c) the Project shall require that certain liability and workers compensation insurance coverage be obtained by the successful bidder in favor of the County; (d) compliance with certain termination, default, warranty, administrative, and reporting requirements described in the bid documents; and (e) payment by the County for construction of the Project shall occur through current County revenues with a 10% retainage as described in the bid documents The Piers and footings are located in the bioretention area. The soil, rock and membrane liner must be moved in a manner so that the membrane will be minimally disturbed and left in place to for the bioretention area and French drain to function properly following the conclusion of this project.
