2023 Residential Asphalt Resurfacing Program The party making the foregoing bid; that such bid is not made in the interest of or on behalf of any undisclosed person, partnership, company, association, organization, or corporation; that such bid is genuine and not collusive or sham; that said authorized representative has not directly or indirectly induced or solicited any other bidder to put in a false or sham bid, and has not directly or indirectly colluded, conspired, connived, or agreed with any bidder or anyone else to put in a sham bid, or that anyone shall refrain from bidding; that said authorized representative has not in any manner, directly or indirectly, sought by agreement, communication or conference with anyone to fix the bid price of said bidder or of any other bidder, or to fix any overhead, profit, or cost element of such bid price, or of that of any other bidder, or to secure any advantage against the public body awarding the contract or anyone interested in the proposed contract; that all statements contained in such bid are true; and, further that said authorized representative has not, directly or indirectly, submitted his bid price or any breakdown thereof, or the contents thereof, or divulged information or data relative thereto, or paid and will not pay any fee in connection therewith, to any corporation, partnership, company, association, organization, bid depository, or to any member or agent thereof, or to any other individual except to such person or persons as have a partnership or other financial interest with said authorized representative in his general business. The above referenced Contractor hereby certifies; that it does not and shall not discriminate against any employee or subcontractor for employment because of race, creed, disability, military status, religion, color, sex, pregnancy, gender identification, sexual orientation, age, genetic information or national origin. If awarded a contract by the City of Centerville, Ohio, the Contractor shall take affirmative action to insure that subcontractor are employed and that employees are treated, during employment, without regard to their race, creed, disability, military status, religion, color, sex, pregnancy, gender identification, sexual orientation, age, genetic information or national origin. If successful as the lowest and best Bidder the Contractor shall post non- discrimination notices in conspicuous places available to employees and subcontractors for employment setting forth the provision of this affidavit. It is hereby agreed that the City of Centerville has the right to reject this proposal, or to award the above described work to the undersigned at the prices stipulated. If the proposal is rejected then the enclosed check for 10% of the amount of the bid, (if a bid bond is not included), which is made payable to the City of Centerville shall be returned to the undersigned as provided in Instruction to Bidders. If the proposal is accepted and the work is awarded and the Undersigned shall fail to enter into a contract in the form and terms set out in the invitation to Bid within ten days after the award shall have been made, then the said check shall be cashed and the amount thereof paid into the Treasury of the City of Centerville as liquidation damages for the failure of the undersigned to comply with the terms of this proposal Planing and resurfacing of residential street citywide including other incidental items.
