Liquidated Damages :- 5 The Successful Bidder agrees to pay as liquidated damages, the sum of four hundred ($400.00) per day for each calendar day beyond one hundred and eighty-five (185) calendar days (substantial completion) for which work in not completed and agrees that this sum is not contingent upon any financial losses incurred by the OWNER due to the delay and is not to be considered as a penalty, but an agreed upon sum to be deducted from CONTRACTORS payment.
