Caution: The County picks up mail at the Post Office at 6 AM each day so if you choose to ship via US mail (including Priority or Express Mail) note that proposals not in the office by 6 AM will be late and not accepted. Proposals received after deadline will not be accepted. Each potential contractor is responsible for their own method of delivery and assurance that the proposal is received by Gaston County Parks and Recreation by the specified time and date. Once a proposal is submitted, potential contractors can withdraw proposal prior to the due date/time. Potential contractors can modify an already submitted proposal only prior to due date/time, and only by a written modification in sealed envelope marked as Modification to Proposal for Grounds and Park Maintenance Region C. 5. Since RFP is for a service contract, proposals will be evaluated based on the criteria listed in the Specifications. Contact Execution with the Successful Contractor The following items (in addition to other requirements listed in the RFP) will be part of any contract that might result from the RFP document: 1. Contract shall be subject to the laws ofNorth Carolina. 2. Any litigation arising from the contract shall take place in Gaston County, N.C. for state court issues and in Charlotte, N.C. for federal court litigation. 3. A non-funding clause must be in any agreement extending into a new fiscal year. 4. Gaston County will not indemnify nor pay for court costs or attorney fees for any reason for the vendor. 5. The vendor will must comply with all E-Verify and Americans with Disabilities Act requirements as per North Carolina and federal laws.
