Bid security in an amount of not less than five percent (5%) of the Base Bid amount submitted is required of each bidder. An acceptable Bid Bond must accompany each bid as a guarantee that, if awarded the contract, the bidder will enter into a contract promptly and execute the required Contract Documents. The successful bidders security will be retained until they have signed the contract. Northern Regional Housing Authority reserves the right to retain the security of the next lowest bidder until the lowest bidder enters into a contract or until thirty (30) days after the bid opening, whichever is shorter. If any bidder refuses to enter into a contract, the Northern Regional Housing Authority may retain their bid security as liquidated damages. Bidders are advised that the specifications of the Project Manual require that Davis-Bacon federal wage rates be paid for labor. Any state labor wage rates that exceed the corresponding federal rate is inapplicable and shall not be enforced. (Federal Register August 10, 1988, 24 CFR Part 905, 941, 965 & 968). The state procurement code, sections 13-1-28 NMSA 1978, imposes civil and misdemeanor criminal penalties for its violation. In addition, the New Mexico criminal statutes impose felony penalties for bribes, gratuities, and kick-backs. Bidders are advised that a liquidated damages clause is included in the Contract, as called for in the General Conditions of the Contract for Construction. No bidder may withdraw their bid within thirty (30) days after the actual date of the bid opening. The Northern Regional Housing Authority reserve the right to reject any or all bids and waive any or all informalities.
