The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs (OFCCP) within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. Bid Bond. All bids must be accompanied by lawful monies of the United States or a Cashier's Check, a Certified Check, Bid Bond, Bank Money Order or Bank Draft, drawn and issued by a National Banking Association located in the State of Oregon, or by any Banking Corporation incorporated under the Laws of the State of Oregon, in an amount equal to not less than ten (10) percent of the total bid, payable to the order of the City of Burns as liquidated damages in the event said successful bidder shall fail or refuse to execute the contract in accordance with the terms of his bid. Performance and Payment Bond. After a contract is awarded, the successful bidder will be required to furnish a separate Performance and Payment Bond, each in the amount of one hundred percent (100%) of the contract. CONTRACTOR REGISTRATION. Pursuant to ORS 279C.365, no bid for a construction contract shall be received or considered by the City unless the Bidder is registered with the Construction Contractors Board or licensed by the State Landscape Contractors Board as specified in OAR 137-049-0230. FUNDING AND AWARD. This contract will be funded in part by a grant from the Federal Aviation Administration. Therefore, award of the Contract by the Sponsor will be made subject to concurrence of FAA. Bidders may not withdraw Proposals for a period of sixty (60) days after the bid opening date. REJECTION OF BIDS. Pursuant to ORS 279C.395, the City may reject any bid not in compliance with the Bidding Documents and all prescribed bidding procedures and requirements and may reject all bids if, in the judgement of the City, it is in the public interest to do so. No Bidder may withdraw its bid after the hour set for the opening thereof and before award of the Contract, unless award is delayed beyond ninety (90) days from the bid opening date.
