Renovation of an educational facility in Middlebury, Indiana. Completed plans call for the renovation of a educational facility.
Bidders will be required to file, with their bids, a certified check made payable to the Middlebury Community Schools or a Bid Bond for an amount not less than five percent (5%) of their maximum bid or bids. Should a successful bidder withdraw its bid, or fail to execute a satisfactory Contract, Middlebury Community Schools may then declare the bid deposit or bid bond to be forfeited as liquidated damages. Each successful bidder shall be required to furnish an approved Performance Bond and a Labor and Materials Payment Bond which cover faithful performance of the contract and the payment of all obligations arising thereunder. A Maintenance Bond shall also be required. Said bonds shall remain in full force and effect for twelve months from the substantial completion of the Work. The Owner reserves the right to reject the bid of any or all bidder in accordance with Indiana Code 36-1-12. In the event the bidder withdraws the bid or fails to execute a satisfactory Contract and furnish a satisfactory Contract Performance Bond, Labor and Material Payment Bond, and Maintenance Bond with a surety company in accordance with Article 11.5 of the General Conditions and Supplementary Conditions, for 100% of the contract amount within ten (10) days after a contract has been awarded to such a bidder by the Owner, said Owner may declare such certified or cashier's check or bid bond forfeited to the Owner for extra costs incurred by reason of delay of the project and obtaining acceptable prices from another bidder.
