The scope of the work is attached in the back pages of the request for proposal per unit. Sicangu Wicoti Awayankapi (SWA) Corporation may award more than one (1) contract. Please place your bid in each of break down the cost for this bid proposal. The selected contractor will be responsible for the cleanup and responsible for payment on roll-offs from RST Solid Waste Management. POTENTIAL CONTRACTORS REQUIRED TO SEE EACH UNIT WITH THE SWA INSPECTOR on March 8th, 9th and 10th, 2023 to schedule starting at 9:00 a.m. (cst) from the SWA Corporation building meet outside and social distancing required. INDIAN PREFERENCE Any firm seeking Indian preference in this award must provide evidence that it is not less than 51 percent Indian owned and controlled. Ask for a pre-qualification application it will be provided to you if you wish to claim the Indian preference. This application can be returned with your bid proposal. The bid proposal shall be returned to SWA Corporation by April 4, 2023 at 2:00 p.m. (central time). The Indian preference evaluation process shall be conducted with the bid evaluation and you shall be officially informed in writing as to your qualification for Indian preference. Should your company have any change then fax or mail to us with your bid proposal a written statement identifying any changes in your organization and we will determine if you continue to be eligible for the preference. Award of Contract and Indian Preference used in the Award: The Contract will be awarded to the lowest responsive and responsible bids except as limited by the following paragraph. Pursuant to Section 7(b) of the Indian Self Determination and Education Assistance Act and HUD requirements set forth at 24 C.F.R.950.175, if a Contract is awarded. The Contract will be awarded to the lowest responsive and responsible proposal received from a pre-qualified Indian enterprise or organization if such bid is within budgeting limits established for construction of this project and is no more than X percent higher than the lowest responsive bid from any qualified non-Indian proposal. X is determined as follows: X equals the lesser of, when the lowest responsive bidder is. Less than $100,000 -10 percent of that bid or $9000; At least $100,000 but less than $200,000 9 percent of that bid (or $16,000); At least $200,000 but less than $300,000 8 percent of that bid (or $21,000); At least $300,000 but less than $400,000 7 percent of that bid (or$24,000); At least $400,000 but less than $500,000 6 percent of that bid (or$25,000); At least $500,000 but less than $1,000,000 5 percent of that bid (or$40,000); At least $1,000,000 but less than $2,000,000 4 percent of that bid (or$60,000); At least $2,000,000 but less than $4,000,000 3 percent of that bid (or$80,000); At least $4,000,000 but less than $7,000,000 2 percent of that bid (or$105,000); $4,000,000 or more 1 percent of the lowest responsive bid with no dollar limit If no responsive and responsible bidder by a qualified Indian enterprise or organization is within the stated range, the award will be made to a responsible bidder with the lowest responsive bid. The Contract that will be used and its terms will be mutually agreed except that all terms and conditions of this Bid, and the funding requirement of the U.S. Department of Housing and Urban Development must be complied with. Furthermore, the Contract shall contain warranties mutually agreed upon. Insurance Certification at or more then the following: A. $300,000.00 Public Liability and Property Damage Insurance B. $300,000.00 Automobile Liability Insurance C. By state regulations Workmens Compensation Insurance The Bidder agrees to secure and maintain, during all times engaged in work under the contract. These insurances must be furnished to the SWA Corporation a copy of the policy evidencing such insurances. The Bidder understands that the failure to carry public General liability and Automobile property insurance with Workmens Compensation insurance in the amounts specified above will cause the Owner to terminate this Agreement. Proposer agrees to hold harmless and indemnify the Owner from and against any and all loss, cost, expense, damages, suits, causes of actions, attorney fees, and any and all other cost or expenses arising out of the performance of the Proposer, or the Proposer agents, servants, or employees. STATEMENTS REGARDING INDIAN PREFERENCE IN SUBCONTRACTING, EMPLOYMENT AND TRAINING All bids must contain a commitment to provide Indian preference in 1) subcontracting, 2) training, and 3) employment, and must contain a statement describing the methods that will be used to provide such preference. This statement will be evaluated as part of the submitted bid, and any bids failing to contain such preference statement or failing to adequately address such preference requirements shall be deemed non-responsive. If you believe it is infeasible to provide Indian preference in subcontracting, training, or employment, you must include in your proposal bid a certification as to the reasons why. Proposals are required to contain the following: Name and address of the entity submitting the proposal and identification of key personnel who will perform the work; Name of each partner and associates if the personnel is a firm and licenses, Certifications and relevant degrees of all professionals; A description of any associates with other firms or any forms of subcontracts; Names, addresses and telephone numbers of at least three references (preferably tribes, tribal housing authorities or other tribal entities); A summary of services currently being offered and a statement of experience. Specific descriptions of experience and ability regarding the services being requested must be included; Statement describing knowledge and experience in various kinds of insurance; Disclosure of any claims, lawsuits or disputes over work or services previously or currently being performed; Lump Sum Price (listed separately for each fiscal year); Proof of eligibility for Indian Preference (if preference is sought); A statement detailing the firm or individuals employment and training opportunities, its plans to provide preference to Indians and the number or percentage of Indians to be employed or trained; Note: All of the RFP documents as detailed in the above shall be submitted or the proposal shall be deemed no responsive. Provide a statement how many days will your company hold firm fixed proposal cost AWARD The contract(s) will only be awarded to responsible individual(s) for firm(s). The contract(s) will be awarded to qualified Indian enterprise(s) submitting the lowest responsive bid proposal if such bid is within budgeting limits established for this solicitation and is within ten percent (10 percent) of the lowest responsive quotation from any qualified individual or firm. If no responsive bid by a qualified Indian enterprise is within the above-stated limits, then award will be made to the individual or firm with the lowest responsive bid. The selected contractor will be responsible for paying all Tribal license fees and taxes, as well as permits that may be required, if any. The successful individual or firm on this solicitation must comply with the Tribes TECRO Ordinance, including any licensing requirements. Tribal minimum wage rates shall not apply. A copy of the Tribes TECRO Ordinance may be obtained from the TECRO office, telephone number (605) 747-2322. The successful individual or firm on this solicitation must also follow the Bonding Requirement 24 CFR part 200.325 or 24 CFR 1000 acceptable methods of securing a project proposal bid amount $250,000.00 and over. SELECTION PROCESS The SWA Corporation reserves the right to interview some or all of the parties submitting proposals. Selection by the SWA Corporation will be based on an evaluation of all applicants and proposals using a point system as follows: 1. Knowledge and experience on construction phrases 0 to 20 points 2. Similar work for other clients, specifically other housing Authorities, Tribal or Indian related owners. 0 to 20 points 3. Timeliness in completing the work requested and tending to the needs of SWA Corporation 0 to 20 points 4. Fee Schedule 0 to 15 points 5. Statement of plan of employment and training to Indians 0 to 10 points 6.
